On the occasion of Hung Kings' death anniversary, April 30 and May 1, how many days off do workers get?

According to the Department of Labor Safety (Ministry of Labor, War Invalids and Social Affairs), in 2024, Hung King's Commemoration Day (10th day of the 3rd lunar month) falls on Thursday, April 18. This is a working day of the week for workers, so the Commemoration Day holiday is only one day off, which is Thursday, April 18.

This year's Victory Day (April 30) and International Labor Day (May 1) holidays both fall on Tuesday (April 30) and Wednesday (May 1). These are also working days of the week, so workers who take this holiday will not be compensated for the holidays. The April 30 and May 1 holidays will last for 2 days, from Tuesday, April 30 to Wednesday, May 1.

According to the 2019 Labor Code, employees are entitled to take time off work and receive full salary according to the labor contract on holidays. In case the weekly day off coincides with a public holiday, the employee is entitled to take the weekly day off in lieu on the next working day.

Regarding overtime pay, according to Article 98 of the 2019 Labor Code, employees who work overtime during the day on holidays and Tet are paid at least 300%, not including holiday pay for employees receiving daily wages.

Based on the announcement from the Ministry of Labor, Invalids and Social Affairs, non-state enterprises can arrange and schedule holidays in accordance with the needs of the enterprise, as well as ensure the rights of employees.

Thus, the Hung Kings Commemoration Day and the 30/4 and 1/5 holidays this year will not be compensated and will be taken according to the schedule as above. During the holidays, employees will still receive full salary.

In case the employee wants to take more time off, he/she can use the annual leave on the days alternating between weekends and holidays to increase the time off to deal with family matters or travel .

In 2024, employees will have another long paid leave, which is the National Day holiday. According to the announcement of the Ministry of Labor, War Invalids and Social Affairs and Official Dispatch 8662/VPCP-KGVX in 2023, officials, civil servants, public employees and employees of administrative agencies, public service agencies, political organizations, socio-political organizations, will have the National Day holiday in 2024 from Saturday, August 31 to Tuesday, September 3. This holiday includes 2 days off for National Day and 2 days off every week.
