Dialogue to resolve prolonged citizen complaints

Currently, there are still cases of citizens of An Giang province making prolonged complaints and denunciations, going beyond the central level in Hanoi, including the case of Mr. Nguyen Minh Dat (residing in Long Kien commune). At the end of June 2025, the Chairman of the Provincial People's Committee had a dialogue to resolve the complaint of Mr. Dat and his family.

According to the case file, the residential land of nearly 1.3 hectares was left by his ancestors to Mr. Nguyen Van Xinh (Mr. Dat's father) to build a house and garden since 1950. In 1960, Mr. Xinh's mother divided half of it to her two aunts. In 1976, the local government divided it for 4 new households to use, with a total area of ​​nearly 3,800m2 . The remaining 1,000m2 of land was used by Mr. Xinh. In addition, Mr. Xinh rented 3.2 hectares of rice fields since 1959. Also in 1976, the local government divided it for 6 households, with a total area of ​​24,700m2 ; the remaining area was used by Mr. Xinh's family. Many years later, Mr. Xinh (later authorized by Mr. Dat) requested the return of the residential land and rice fields; Compensation for wrongful loss from the date of land acquisition until now, plus bank interest calculated from 1977 until now.

On June 12, 2002, the Chairman of the Provincial People's Committee signed Decision 1447/QD-UB-KN, forcing households to pay Mr. Xinh the results of their labor on agricultural land, which is 25 bushels of rice/ 1,000m2 . For residential land, 4 households were forced to compensate 18,000 VND/ m2 ; Mr. Xinh's complaint was rejected to reclaim all the rice fields and residential land. According to the verification of the specialized sector, the State manages land and adjusts according to land policies, so Mr. Dat's land reclaiming has no basis for settlement. The Chairman of the Cho Moi District People's Committee and the Chairman of the An Giang Provincial People's Committee issued decisions to resolve the first and second complaints in accordance with the law and within their authority.

In Report 2508/BC-TTCP, dated August 31, 2015, the Government Inspectorate affirmed: “Mr. Dat's complaint requesting the return of the above two plots of land has no basis for consideration. Agree with the settlement decisions of the Provincial People's Committee and the conclusion of the State Inspectorate. Agree with the policy of the Provincial People's Committee to provide additional support to Mr. Dat's family with 150 million VND" (approved by the Prime Minister in Document 8323/VPCP-VI, dated October 13, 2015). However, Mr. Dat did not agree and continued to complain to the Central agencies.

The Provincial People's Committee proposed a plan to support Mr. Nguyen Van Xinh's co-heirs with 150 million VND. Because Mr. Dat's complaint has lasted for many years, in order to ensure the rights of his family, the Provincial People's Committee applied Article 468 of the Civil Code, adding an interest rate of 20%/year for the amount of 150 million VND from 2001 to 2025 (25 years). In total, support for Mr. Xinh's co-heirs with 900 million VND; support 3 brothers of Mr. Dat (Nguyen Minh Dat, Nguyen Thi Thu Ha, Nguyen Kim Nen) with 16,000m2 of agricultural land in Luong An Tra commune (now Vinh Gia commune) so that they have land to cultivate, stabilize their lives and end their complaints.

Deputy Chief Inspector of An Giang Province Khuu De Danh said: “On June 18, 2025, the Provincial Working Group asked for opinions from Working Group No. 3, Government Inspectorate on the plan to resolve the complaint of Mr. Dat's family. Accordingly, to ensure sufficient legal basis for calculating interest, the Provincial People's Committee agreed to assign the Department of Finance to issue a document requesting the province's commercial bank to calculate interest on the amount of 150 million VND from October 10, 2001 to June 30, 2025, to support Mr. Xinh's co-heirs. Regarding agricultural land, we agreed with the province's proposal to support Mr. Dat's three brothers with 16,000 square meters of land. The cost to resolve the amount of nearly 900 million VND is from the provincial budget.”

However, at the dialogue session on June 27, 2025, Mr. Dat did not agree with the resolution of the Provincial People's Committee. "We request the Provincial People's Committee to provide the conclusion of the Government Inspectorate Working Group to the family; at the same time, request the Provincial People's Committee to issue a document to end the case" - Mr. Dat expressed his opinion. Ms. Ha also did not agree with the resolution of the Provincial People's Committee; requested support to resolve the agricultural land in Cho Moi.

After listening to the speeches of the specialized agencies and citizens at the dialogue session, the alternate member of the Party Central Committee, Deputy Secretary of the Provincial Party Committee, Chairman of the An Giang Provincial People's Committee Ho Van Mung agreed with the proposed plan of the Provincial Inspectorate. However, in case of agreement on this solution, Mr. Dat's family is requested to carry out the authorization procedure in accordance with regulations, the Provincial People's Committee will resolve according to the announced plan. In case he does not agree with the solution, the Provincial People's Committee will report the results of the inspection and review to the Government Inspectorate.
