Speaking at the conference, Lieutenant General, Associate Professor, Dr. Ngo Trong Cuong, Deputy Director of the National Defense Academy, assessed: The Draft Law on State of Emergency was carefully prepared by the Drafting Committee, closely following the Party's policies and guidelines; in accordance with the Constitution, ensuring consistency with the legal system, compatibility with relevant international treaties to which Vietnam is a member; ensuring feasibility, meeting practical requirements.

In Clause b, Point 2, Article 18 of the Draft Law, there is the content: "The Presidium of the Central Committee of the Vietnam Fatherland Front and the Vietnam Red Cross Society mobilize donations and allocate resources for emergency and medium-term support; coordinate with the People's Committees at the same level to receive and allocate resources for emergency relief and medium-term support". Lieutenant General Ngo Trong Cuong commented, changing the word "same level" in the above content to "all levels" because the Presidium of the Central Committee of the Vietnam Fatherland Front and the Vietnam Red Cross Society are at the central level, while the People's Committees are only at the provincial and communal levels.

In Clause 3, Article 24: “When declaring a state of emergency regarding national security, social order and safety and a state of emergency regarding national defense, the Prime Minister decides to establish a National Steering Committee on the state of emergency”. Lieutenant General Ngo Trong Cuong said that it is necessary to separate each state in this clause, because these are two separate states at two different levels.

In Clause 7, Article 3 of the Draft Law stipulates: When deciding on measures to respond to and overcome the consequences of an emergency that causes damage, the decision maker shall not be held responsible if the decision is not motivated by personal gain.

According to Colonel, Lawyer Nguyen Van Truong, former Chief Justice of the Central Military Court of Appeal, the above regulation does not eliminate the case where a responsible person, although not motivated by personal gain, is negligent, fails to observe and consider the specific context, and hastily issues a decision causing damage to the life and health of others.

To enhance the sense of responsibility and limit carelessness and indifference when issuing decisions in a state of emergency, Lawyer Nguyen Van Truong proposed to clearly divide responsibilities into 3 categories: criminal, civil and administrative responsibilities. Those who are careless and irresponsible when issuing decisions in a state of emergency, even though they do not have a profit motive but cause damage, will only be exempted from criminal and civil responsibilities, but will still be considered for administrative responsibilities.

At the conference, experts agreed on the need to promulgate the Law on State of Emergency and gave many specific comments on many clauses, points and articles of the Draft Law.
