Delegate Truong Trong Nghia (HCMC) said that regarding mini apartments, the current legal system can completely handle it if strictly inspected and monitored. Therefore, he suggested not to raise the issue of amending the law to legalize apartments that show signs of violations.

Sharing the same view, Delegate Nguyen Thi Thuy (National Assembly Delegation of Bac Kan province) pointed out the fact that there is a lack of legal corridor for managing mini apartments, loopholes in the legal system have led to loopholes in the management of mini apartments.

According to the delegate, the current legal regulations on this type of housing are very loose, in which Clause 2, Article 46 of the current Housing Law devotes a paragraph to describing this type of housing but is unclear about the standards, regulations as well as management requirements, and even the identification is not really clear.

Meanwhile, the whole society calls this product a mini apartment - a term not in the law.

"Such loose regulations lead to a lack of appropriate legal corridors, causing confusion in management, putting pressure on urban infrastructure and especially posing a high risk to people's safety," said the delegate.

Ms. Thuy agrees with the opinion that the emergence of mini apartments in recent times has met the needs of many people with low-middle incomes. But she definitely does not legalize the violations of mini apartments in the Housing Law.

From the above analysis, Ms. Thuy recommends that the Government continue to implement preferential solutions to unblock the supply of social housing and affordable commercial housing; The Government directs agencies that are conducting inspections and checks of mini apartments, in addition to inspections to detect violations, which is necessary, but through inspections, it is also necessary to provide timely guidance to people to have solutions to prevent fire and explosion safety.

At the same time, the resolution of this session of the National Assembly recommends requirements on ensuring fire safety in general, including fire safety for existing mini-apartments.

Also debating about mini apartments, delegate Leo Thi Lich (Bac Giang) said that creating conditions for low-income people to have a place to live, study and work is very necessary.

But that does not mean that we should loosen our management of infrastructure construction and urban management in residential areas, boarding houses and apartment buildings and not ensure safety. The licensing is wrong and not in accordance with the regulations on construction licensing for these houses and must be strictly handled.
