Lai Chau: Strengthening propaganda and dissemination of legal documents on karaoke service business

The Department of Culture, Sports and Tourism of Lai Chau province regularly propagates and disseminates the implementation of legal documents on karaoke service business to households and businesses operating karaoke service business in the area to strictly comply with regulations on karaoke business activities.

According to the Department of Culture, Sports and Tourism of Lai Chau province, karaoke is a modern form of entertainment, born to meet the singing needs of the public. In recent years, karaoke services have continuously developed, contributing to expanding cultural space, enriching the ideological and emotional life of people, especially young people. Today, karaoke appears in many countries, attracting the participation of many social classes. Regarding the benefits that karaoke brings, it can be seen that karaoke is a modern form of entertainment that meets the singing needs of the public.

With just a small amount of money, people can buy karaoke machines and systems to serve their entertainment needs, enjoy music and show off their singing voice comfortably, proactively with time and save money.

Along with the development of social life, karaoke has expanded in space, accompanied by karaoke are other dining, entertainment and recreation services.

Nowadays, karaoke activities appear a lot in urban areas, big cities and even in rural villages with modern invested rooms, sound systems, lights and images, attracting many participants, especially teenagers, contributing to improving the quality of people's spiritual life.

From 2013 to present, implementing Decision No. 41/2012/QD-UBND dated December 13, 2012 of Lai Chau Provincial People's Committee on decentralization, authorization, management of karaoke business license issuance.

In 2012, implementing Decree No. 103/2009/ND-CP dated November 6, 2009 of the Government, the Department of Culture, Sports and Tourism advised the Provincial People's Committee to issue Decision No. 41/2012/QD-UBND dated December 13, 2012 of the Lai Chau Provincial People's Committee on decentralization and authorization of management and issuance of Karaoke Business Licenses.

On November 12, 2024, the Government issued Decree No. 148/2024/ND-CP amending and supplementing a number of articles of Decree No. 54/2019/ND-CP dated June 19, 2019 of the Government regulating karaoke service business, discotheque service business and Consolidated Document of Decree No. 148/2024/ND-CP dated November 12, 2024 of the Government amending and supplementing a number of articles of Decree No. 54/2019/ND-CP dated June 19, 2019 of the Government regulating karaoke service business, discotheque service business.

The Department of Culture, Sports and Tourism recognizes that decentralization of state management is the arrangement of tasks and powers between government levels, between central and local governments, and between local government levels in implementing state management rights in a specific field on the basis of ensuring the conformity between functions and tasks with the capacity and actual conditions of each level to enhance the quality, effectiveness and efficiency of state management activities.

Therefore, advising on the Draft Decision on decentralization of procedures for granting, adjusting, and revoking Licenses for eligibility to conduct karaoke business in Lai Chau province to ensure the implementation of 2-level local government, the development and promulgation of a Decision on decentralization of granting, adjusting, and revoking Licenses for eligibility to conduct karaoke business for karaoke business households in Lai Chau province to replace Decision No. 41/2012/QD-UBND on decentralization and authorization of management of granting karaoke business licenses is very necessary, strengthening decentralization and delegation of authority, creating initiative in management work by local sectors and fields, in accordance with the administrative reform plan.

After Decree 54/2019/ND-CP took effect, the Department of Culture, Sports and Tourism proactively guided the implementation of specific regulations on karaoke service business to businesses, karaoke service business households; other agencies, organizations and individuals related to karaoke service business in the whole province.

Provide guidance on the development of procedures and conditions for granting karaoke business licenses in the area; announce and publicize administrative procedures for karaoke service business; strictly and in accordance with current regulations on appraisal and granting licenses for karaoke service business eligibility in accordance with the law and the guidance of the Department of Culture, Sports and Tourism.

Regularly propagate and disseminate the implementation of legal documents on karaoke service business to households and businesses operating karaoke services in the area to strictly comply with regulations on karaoke business activities according to the content of Decree No. 54/2019/ND-CP dated June 19, 2019. Advise on the establishment and timely completion of the 814 Interdisciplinary Inspection Team when there is a change in members; proactively coordinate with the 814 Interdisciplinary Inspection Team to conduct inspections of karaoke service business establishments; handle administrative violations if establishments are found to have violations.

Regarding the implementation results, the current situation related to social relations, up to now in Lai Chau province there are 66 karaoke service business establishments. In the whole province there are no dance hall business activities.

From 2019 to present, 09 new establishments have been granted; licenses for 04 karaoke service business establishments have been adjusted.

From 2019 to present, the Inspectorate of the Department of Culture, Sports and Tourism has coordinated with the Department of Internal Political Security (PA03), the Department of Administrative Management of Social Order (Department PC06) - Lai Chau Provincial Police; the Department of Culture and Information of districts and cities to conduct 12 inspections of 119 karaoke service establishments in the whole province.

The management agencies have presided over and coordinated to advise on the effective implementation of state management of karaoke service business activities in the management area. Timely advise on contents related to karaoke services. Strictly implement public posting and follow the correct administrative procedures in the karaoke field. Through the results of annual inspections, in general, karaoke service business establishments strictly implement the regulations on karaoke service business according to Decree No. 54/2019/ND-CP and epidemic prevention work according to regulations.

The 814 joint inspection team conducted 38 inspections of karaoke establishments in the management area. After the inspection, the business operations of 05 establishments were temporarily suspended; the licenses were revoked and 02 establishments were required to stop operations due to not meeting the conditions for the Karaoke business.

Administrative sanctions were imposed on 04 karaoke businesses for violations of fire prevention, fighting and security and order regulations.

Implementing the 2-level local government model, on September 5, 2025, Lai Chau Provincial People's Committee issued a decision on Decentralization of procedures for granting, adjusting and revoking licenses for eligibility to conduct karaoke services in Lai Chau province.

Accordingly, the People's Committees of communes and wards are delegated the authority to issue, adjust and revoke licenses for eligibility to conduct karaoke services.

The order and procedures for granting, adjusting and revoking the License for eligibility to conduct karaoke services and related contents shall comply with the provisions of Decree No. 54/2019/ND-CP dated June 19, 2019 of the Government regulating the business of karaoke services and discotheque services; Decree No. 148/2024/ND-CP dated November 12, 2024 of the Government amending and supplementing a number of articles of Decree No. 54/2019/ND-CP dated June 19, 2019 of the Government regulating the business of karaoke services and discotheque services and relevant legal provisions.

Lai Chau Provincial People's Committee assigned the Department of Culture, Sports and Tourism to preside over and coordinate with relevant agencies and units to advise the Chairman of the Provincial People's Committee to announce the list and internal procedures for handling administrative procedures decentralized to the People's Committees of communes and wards; inspect, monitor, guide and synthesize the implementation status, and propose measures to handle arising difficulties and problems.

The People's Committees of communes and wards are responsible for organizing the implementation of decentralized contents according to the provisions of law; are responsible before the law and the Provincial People's Committee for the results of implementing decentralized tasks and powers; periodically report and evaluate the implementation of decentralized tasks and powers to the Provincial People's Committee (through the Department of Culture, Sports and Tourism) for monitoring and synthesis.
