Accordingly, Lam Dong Provincial People's Committee has assigned the Department of Natural Resources and Environment to preside over and coordinate with the Department of Planning and Investment, the Department of Finance, the Tax Department and localities to review investment projects using non-budgetary capital in the province but not implemented, behind schedule, not putting land into use, slow to put land into use. From there, it can be handled according to competent regulations or proposed to the Provincial People's Committee to handle according to the following options.
For projects that have been granted an extension of the time to put land into use according to the provisions of the Land Law and adjusted the progress according to the provisions of the Investment Law with a maximum period of 24 months as prescribed, but the time to put land into use has exceeded without investment and completion according to the approved progress and commitment of the investor, based on the provisions of law, establish procedures to terminate the project or terminate a part of the project that has not been invested. At the same time, proceed with land recovery, including cases where land has been allocated with land use fees collected, or land lease with one-time payment of land rent for the entire lease term.
Projects that are not implemented, are behind schedule, or do not fulfill their commitments will be terminated.
For projects that are eligible for land use period extension according to the provisions of the Land Law and progress adjustment according to the provisions of the Investment Law, the competent authority must guide enterprises to prepare documents, including requiring investors to have a written commitment that this is the final extension. If the commitment and extension period are not completed correctly, the State will terminate the project, reclaim the land, consider extending the land use period and adjust the investment progress according to the provisions of law.
This is not the first time that Lam Dong Provincial People's Committee has taken strong action against projects that are not implemented or are behind schedule. Previously, in September 2022, the Vice Chairman of Lam Dong Provincial People's Committee signed Decision No. 1655/QD-UBND on terminating the Trung Nguyen Legend - Loc An Coffee Exhibition and Display Area project of Trung Nguyen Coffee Joint Stock Company (Trung Nguyen Company) in Loc An commune, Bao Lam district.
Regarding the reason, the termination of this project was carried out according to Inspection Conclusion No. 9097/KL-BKHĐT of the Inspectorate of the Ministry of Planning and Investment. In which, the project of Trung Nguyen Company was behind schedule, violating the Land Law 2013, Investment Law 2014 and Investment Law 2020.
Lam Dong Provincial People's Committee requests Trung Nguyen Company to be responsible for completing the project liquidation procedures and performing the investor's obligations according to regulations. The area leased to Trung Nguyen Company after being recovered will be handed over to Bao Lam District People's Committee for management.
