Vice Chairman of the National Assembly Le Minh Hoan attends the plenary session of the Committee on Science, Technology and Environment

On the morning of October 10, at the Headquarters of the National Assembly agencies (22 Hung Vuong, Hanoi), Central Party Committee member, Vice Chairman of the National Assembly Le Minh Hoan attended and delivered a speech at the Fourteenth Plenary Session of the Committee on Science, Technology and Environment.

Vice Chairman of the National Assembly Le Minh Hoan gave a speech at the meeting.

Attending were: members of the Committee on Science, Technology and Environment; representatives of the Standing Committee of the Nationalities Council and Committees of the National Assembly; representatives of the leaders of the Ministry of Agriculture and Environment .

Speaking at the meeting, Vice Chairman of the National Assembly Le Minh Hoan stated that at this plenary session, the Committee on Science, Technology and Environment will examine six draft laws that are expected to be submitted to the National Assembly for comments and consideration and approval at the upcoming 10th Session, including: the draft Law on amending and supplementing a number of articles of the Law on Geology and Minerals; the draft Law on amending and supplementing a number of articles of 15 laws in the fields of agriculture and environment; the draft Law on Construction (amended); the draft Law on Digital Transformation; the draft Law on High Technology (amended); the draft Law on amending and supplementing a number of articles of the Law on Technology Transfer.

Based on the opinions at the meeting, the Vice Chairman of the National Assembly proposed that the Standing Committee of the Science, Technology and Environment Committee complete the draft report on the review of the Law project and submit it to the National Assembly Standing Committee for comments before submitting it to the National Assembly at the 10th Session.

In this morning's meeting, delegates examined the draft Law amending and supplementing a number of articles of the Law on Geology and Minerals.

Presenting the Draft Law, Deputy Minister of Agriculture and Environment Tran Quy Kien said that the draft Law has 3 articles, including the following contents: legalizing regulations on decentralization and delegation in the field of geology and minerals according to the 2-level local government model currently stipulated in Decree No. 136/2025/ND-CP dated June 12, 2025 of the Government regulating decentralization and delegation in the field of agriculture and environment; reducing and simplifying administrative procedures in licensing mineral activities, contributing to unlocking mineral resources to serve the construction and development of public investment projects and works according to the provisions of the law on public investment; investment projects implemented under the public-private partnership method, key and important national projects and works; socio-economic development projects and works under the authority of local authorities to approve and decide on investment policies; Implement reasonable decentralization and delegation of power between the central and local levels, taking management efficiency as the center, and taking people and businesses as the subjects of service.

Through discussion, delegates basically agreed with the necessity and scope of regulation of the draft Law.

Delegates focused on giving opinions on 6 groups of policies proposed by the Government, including: amending and supplementing regulations on licensing mineral activities in groups III and IV to provide construction materials for public investment projects according to the provisions of the law on public investment; investment projects implemented under the public-private partnership method; key and important national works and projects; socio-economic development works and projects under the approval and investment policy decision authority of local authorities; urgent construction works and tasks according to the provisions of the law on construction; projects and works for natural disaster prevention and control according to the provisions of the law on natural disaster prevention and control. Amending and supplementing a number of contents related to the criteria for delimiting areas where mineral exploitation rights are not auctioned to ensure raw materials and materials for public investment works and projects according to the provisions of the law on public investment; investment projects implemented under the public-private partnership method; key and important national projects and works... Allow state management agencies to grant licenses for deep exploration and expansion to organizations and individuals that are legally exploiting minerals without having to adjust or supplement the mineral planning before granting the exploration license; based on the results of mineral exploration, the mineral planning management agency updates and supplements the mineral planning as a basis for managing mineral activities. Amend and supplement regulations on rare earth management. Amend and supplement regulations on the right to prioritize applications for mineral exploitation licenses for mineral resources and reserves that have been recognized by competent state agencies. Amend and supplement regulations on mineral exploration, exploitation, mineral recovery, and finance in mineral activities; transitional regulations.

Representative of the Ministry of Agriculture and Environment presented the Proposal on the draft Law amending and supplementing a number of articles of the Law on Geology and Minerals.

Delegates noted that at the upcoming session, the National Assembly is expected to comment on about 50 draft laws. The number of draft laws that will be considered and approved by the National Assembly according to the procedure at a session is very large. Therefore, delegates suggested that the drafting agency coordinate with the reviewing agency to carefully review and ensure the consistency and uniformity of the draft law with the draft laws that will be submitted to the National Assembly for consideration and approval at the upcoming 10th session; at the same time, ensuring the suitability and uniformity with the current legal system.

Concluding the discussion, Vice Chairman of the National Assembly Le Minh Hoan emphasized that the draft Law needs to shift from the mindset of "if you can't manage it, then ban it" to creating development, ensuring that the goal of the draft Law is to promptly resolve problems arising in the practical implementation of the Law, especially issues related to the licensing mechanism, exploitation and use of minerals for the construction of important national works and projects; urgent and urgent investment projects decided by competent authorities; public investment projects, investment projects under the public-private partnership method; socio-economic development works and projects under the approval and investment policy decision authority of local authorities according to the provisions of the law on investment; regulations on criteria for delimiting areas where mineral exploitation rights are not auctioned have not met the requirements of releasing all resources, including mineral resources, for socio-economic development in the new situation; legalizing regulations on decentralization, decentralization and especially separate regulations on rare earth management in the new situation.

The Vice Chairman of the National Assembly also noted that the draft Law needs to closely follow the viewpoint of implementing innovative thinking in law-making, only regulating issues under the authority of the National Assembly, long-term regulations; the rest should promote empowerment of the Government to create proactiveness and flexibility in management and administration.
