Removing obstacles in licensing procedures, exploitation and use of minerals

On the afternoon of September 3, at the Hanoi bridge, Deputy Prime Minister Tran Hong Ha chaired an online meeting on the Draft Law amending and supplementing a number of articles and clauses of the Law on Geology and Minerals.

At Lam Dong bridge, Vice Chairman of Lam Dong Provincial People's Committee Nguyen Ngoc Phuc chaired. Attending were representatives of the leaders of the departments: Agriculture and Environment, Science and Technology, Industry and Trade, Construction, Finance, Justice.

According to the Ministry of Agriculture and Environment , the amendment and supplementation of a number of articles of the Law on Geology and Minerals aims to promptly remove difficulties arising in practical implementation, especially regarding the licensing mechanism, exploitation and use of minerals for key projects, public investment projects, and driving projects, contributing to speeding up procedures for implementing infrastructure development projects and key national projects.

Specifically, the Draft proposes that the mineral and geological planning management agency update information and data after the license for deep exploration and expansion is granted; investment projects under the public-private partnership method do not have to be based on land use plans; adjust mineral exploitation licenses to increase the capacity of exploiting group III minerals for common construction materials, group IV minerals for mineral mines with valid mineral exploitation licenses; shorten procedures for exploration, recognition, mineral exploitation, and registration of mineral recovery when responding to emergency situations of natural disasters; add fees mineral reserve appraisal, mine closure project...

Deputy Prime Minister Tran Hong Ha emphasized that the Law on Geology and Minerals provides general regulations on geology and minerals; the Government Resolution specifically addresses the fields of geology and minerals along with other related issues.

Legal problems related to the field of geology and minerals need to be classified and proposed to supplement the forms of settlement stipulated in the articles and clauses of the Law on Geology and Minerals and the Resolution of the Government. The application of special mechanisms in urgent cases of mineral exploitation must fully meet the specific criteria.

Deputy Prime Minister Tran Hong Ha directed the Ministry of Agriculture and Environment to synthesize comments from ministries, branches and localities to complete the draft supplement to the Law on Geology and Minerals and the Resolution guiding its implementation, and soon submit it to the National Assembly for approval and the Government for promulgation.

In particular, clarify the definition and regulations on handling planning projects in other fields that overlap with planning in the field of geology and minerals. When exploring and investigating all resources, it is necessary to assess reserves and plan effective exploitation strategies. For mines that have been previously planned and licensed to stabilize raw material areas and identify investors, bidding and auctions will not continue. The non-organization of bidding and auctions for mineral exploitation must be for the right subjects, harmonizing the interests of the state and enterprises, ensuring publicity and transparency.

In addition, mineral exploitation licenses must ensure that the plans do not cause landslides or pollute the surrounding environment; it is strictly forbidden to legalize illegal mineral exploitation...
