Vice Chairman of the Committee for Science, Technology and Environment Ta Dinh Thi said that, in response to practical requirements, the amendment and supplementation of a number of articles of the Law on Geology and Minerals aims to promptly resolve problems arising in the implementation of the Law, especially issues related to licensing mechanisms, exploitation and use of minerals for key projects, public investment projects and driving projects.

The amendment and supplementation of a number of articles of the Law on Geology and Minerals will contribute to speeding up procedures for implementing infrastructure development projects and key national projects that need to be started to welcome the 14th National Party Congress; at the same time, it is a practical solution to promote socio -economic development, contributing to the completion of the GDP growth target of 8% or more in 2025, creating a solid foundation towards double-digit growth in the following years.

Regarding the basic contents, the Deputy Chairman of the Committee for Science, Technology and Environment said that the draft Law has concretized the major orientation of the Party and State on continuing to innovate the organization and operation of the state administrative apparatus, implementing reasonable decentralization and delegation of power between the Central and local levels, taking management efficiency as the center, and taking people and businesses as the subjects of service.

The Draft Law also stipulates the reduction and simplification of administrative procedures such as: not having to carry out procedures for submitting to competent state agencies to decide or approve investment policies, approve investment projects according to the provisions of the law on investment for the exploitation of group III and group IV minerals to supply works, projects, and tasks in the case of construction of important national projects, urgent public investment projects, works, and work items under national target programs according to the provisions of the law on public investment...

Along with that is the legalization of regulations on decentralization and delegation of authority in the field of geology and minerals according to the 2-level local government model; proposing to amend and supplement a number of policy groups related to the authority to grant operating licenses in the field of geology and minerals.

The Vice Chairman of the Committee for Science, Technology and Environment emphasized that Quang Ninh has rich mineral resources with 209 mines. and ore points of 36 types of minerals have been investigated, explored and evaluated; is one of the typical localities, leading in mineral exploitation activities. Therefore, the Working Group hopes that the People's Committee of Quang Ninh province will exchange, share and clarify the difficulties and obstacles in law enforcement in the management of the field of geology and minerals and make proposals and recommendations to contribute to the completion of the draft Law.

Reporting to the working delegation, Deputy Director of the Department of Agriculture and Environment of Quang Ninh province, Ngo Thanh Tam, said that recently, the state management of mineral exploitation activities in Quang Ninh province has been seriously implemented, well performing the tasks and requirements in the state management of minerals in the area.

The Law on Geology and Minerals 2024, Decree No. 136/2025/ND-CP dated June 12, 2025, Decree No. 193/2025/ND-CP dated July 2, 2025 of the Government have been issued to promote decentralization, delegation of authority, clearly define authority, simplify administrative procedures, clearly classify each type of mineral, remove many bottlenecks and bottlenecks arising from practical state management work and the implementation process of enterprises.

To resolve some problems arising from management practices, the People's Committee of Quang Ninh province proposed to amend and supplement 50/111 Articles of the current Law, mainly amending policies related to rare earth, mineral group classification, decentralization, delegation of authority and regulations on exploration/exploitation.

In addition, the People's Committee of Quang Ninh province proposed to keep 61/111 Articles; add Chapter VIIa on state management of geology and minerals for rare earth, including 04 Articles: 85a, 85b, 85c, 85d.

Regarding the establishment of the Mine Closure Council, the People's Committee of Quang Ninh province said that Clause 3, Article 83 of the draft Law stipulates that the appraisal of mineral mine closure projects is carried out through the Mineral Mine Closure Project Appraisal Council. Clause 3, Article 101 of Decree 193/2025/ND-CP dated July 2, 2025 (abbreviated as Decree No. 193) guiding the implementation of the Law on Mineral Geology stipulates: The Mineral Mine Closure Project Appraisal Council has at least 9 members. According to the representative of the Department of Agriculture and Environment of Quang Ninh province, the regulation of at least 9 members leads to difficulties in implementation; therefore, it is proposed to amend and supplement Clause 3, Article 83 in the direction: the appraisal of mineral mine closure projects is carried out through the Mineral Mine Closure Project Appraisal Council; The Mineral Mine Closure Project Appraisal Council has at least 6 members. The Government shall specify in detail the structure of the council members.

At the meeting, delegates discussed and clarified further difficulties and obstacles in implementing decentralization and delegation of authority in geological and mineral management; ensuring conditions for implementing decentralization and delegation of authority according to the motto "locality decides, locality acts, locality takes responsibility".

Receiving the proposals and recommendations of the People's Committee of Quang Ninh province, Vice Chairman of the Committee for Science, Technology and Environment Ta Dinh Thi requested the representative of the Ministry of Agriculture and Environment to study, explain and receive the proposed and recommended contents to complete the draft Law; requested the People's Committee of Quang Ninh province to continue to coordinate with the drafting agency and the reviewing agency in the process of completing the draft Law.
