Regulations on subjects awarded the Medal "For the cause of building the Capital"

The Resolution clearly states that the "For the cause of building the Capital" Medal is awarded to individuals who have well implemented the Party's policies and the State's laws and policies, have contributed to the development of the Capital Hanoi , and meet one of the following criteria: individuals who have lived or are living, working, or participating in revolutionary activities in Hanoi and are one of the following subjects:

Participated in revolutionary activities in Hanoi before August 19, 1945; Participated in the resistance war against France and the US in Hanoi and was awarded the Medal of Resistance War against France and the US, or was an individual residing in Hanoi during that time and participated in the resistance war against France and the US in localities outside Hanoi and was awarded the Medal of Resistance War against France and the US;

Awarded the "Glorious Youth Volunteer" Medal for achievements during the time working in Hanoi or individuals who are citizens residing in Hanoi during that time participating in the Youth Volunteers in localities outside Hanoi and are awarded the "Glorious Youth Volunteer" Medal;

Individuals awarded the title "Heroic Vietnamese Mother" have relatives who participated in activities, fought and sacrificed in Hanoi.

Individuals who have held or are holding one of the following positions: Secretary, Deputy Secretary of the Hanoi Party Committee; Chairman of the People's Council, People's Committee of Hanoi.

Member of the Standing Committee of the Hanoi Party Committee; Vice Chairman of the People's Council and People's Committee of Hanoi; Chairman of the Vietnam Fatherland Front Committee of Hanoi.

Head of Party committees and agencies directly under the Hanoi Party Committee; Member of the Executive Committee of the Hanoi Party Committee; Director of departments, heads of agencies, sectors, socio-political organizations and equivalent positions of the City; Secretary of districts, towns, and Party committees directly under the Hanoi Party Committee with a term of office of 5 years or more.

Deputy Head of Party Committee, agencies directly under Hanoi Party Committee; Vice Chairman of Vietnam Fatherland Front Committee of Hanoi City; Secretary of Central Party Committee members who are leaders of Hanoi City, Deputy Director of Department, Deputy Head of agencies, departments, branches, socio-political organizations and equivalent in the City; Deputy Secretary of District, Town, City, Party Committee directly under Hanoi Party Committee; Chairman of People's Council, People's Committee; Member of Inspection Committee of City Party Committee; Head of City-level associations assigned to the payroll with a term of 8 years or more in office.

Being a City People's Council delegate who has participated in 2 terms (from 10 years) or more;

Titles equivalent to district committee members before April 30, 1975 include: Head of district-level departments and branches; Deputy District Military Command; Deputy Secretary, Vice Chairman of provincial-level mass organizations; Provincial committee member, Provincial Military Command member, Provincial Security Commissioner...

The Resolution also clearly states that the following cases will not be considered for awarding the Medal "For the cause of building the Capital": individuals who are under disciplinary review or are involved in criminal cases that have not yet been concluded by competent State agencies.

The individual is currently serving one of the disciplinary forms. The time spent serving the disciplinary form is not counted towards the working time for consideration of awarding the Commemorative Medal...

Individuals awarded with Commemorative Medals, Diploma frames, Commemorative Medals, Commemorative Medal boxes and bonuses are at the maximum level as prescribed in Decree No. 98/2013/ND-CP dated December 31, 2023 of the Government detailing the implementation of a number of articles of the Law on Emulation and Commendation, which is 0.6 times the basic salary.

Bonuses for individuals are deducted from the City's Emulation and Reward Fund according to current regulations.

Previously, presenting the review report of the Legal Committee, Deputy Head of the Legal Committee of the City People's Council Hoang Thuy Hang said: from the time of issuance of Resolution No. 30/2022/NQ-HDND (December 2022) to now, the City has considered awarding the Badge "For the cause of building the Capital" to 19 individuals living and working at agencies and units in the capital.

The awarding of the Badge "For the cause of building the Capital" is a State management measure and policy that has contributed to perfecting State management in the field of emulation and rewards in Hanoi; at the same time, effectively encouraging individuals with achievements contributing to the cause of building and developing the Capital in recent times.

On May 16, 2022, the National Assembly passed the Law on Emulation and Commendation (effective from January 1, 2024, replacing the previous Laws on Emulation and Commendation). Clause 2, Article 71 of the 2022 Law on Emulation and Commendation stipulates: "Commemorative medals are awarded to individuals who have contributed to the development of ministries, branches, sectors, provinces, political organizations, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations with party organizations or party organizations belonging to the Eastern bloc of central agencies.

The name of the commemorative medal, the subjects and criteria for increasing the commemorative medal are prescribed by the Ministry, branch, provincial level...

In addition, during the implementation of Resolution No. 30/2022/NQ-HDND on the consideration of the Badge "For the cause of building the Capital", it has been shown that some provisions in the Resolution need to be amended and supplemented, especially regarding the name, the subjects of the criteria and the process of considering the title to be consistent with the new regulations promulgated in the Law on Emulation and Commendation in 2022 and consistent with the conditions and practical circumstances of the Capital to ensure consistency and synchronization between the Central legal documents and the City's legal documents. Therefore, the submission of the City People's Committee to the City People's Council for consideration and decision on the policy of drafting the above Resolution of the City People's Council is necessary, within its authority and with sufficient legal basis.
