To overcome the shortcomings caused by the weak position of consumers in their relationship with business organizations and individuals when conducting transactions, the draft Law on Consumer Rights Protection (amended) has been absorbed and revised, thereby affirming that protecting consumer rights is a common responsibility of the whole society and protecting consumers is contributing to protecting the constitutional rights of each citizen.

According to the agenda of the 5th Session, on the morning of May 26, the National Assembly discussed in the hall a number of contents with different opinions of the draft Law on Consumer Rights Protection (amended). Before the discussion, the National Assembly listened to the member of the National Assembly Standing Committee, Chairman of the National Assembly's Committee on Science, Technology and Environment Le Quang Huy present a Report on explanation, acceptance and revision of the draft Law.

Step by step forming consumer initiative

Presenting the Report on explanation, acceptance and revision of the draft Law on Consumer Rights Protection (amended), Chairman of the Committee on Science, Technology and Environment Le Quang Huy said that the draft Law, after being accepted and revised according to the opinions of National Assembly deputies at the 4th Session and the opinions of National Assembly delegations and relevant agencies, has met the viewpoints, goals and requirements set out when amending the Law.

Specifically, the Law on Consumer Rights Protection is identified as a general regulatory law in the system of legal documents on consumer rights protection, and is the standard and basis for reference in the process of developing or implementing other legal documents related to consumer rights protection.

The Law affirms that protecting consumer rights is a common responsibility of the whole society and protecting consumers is contributing to protecting the constitutional rights of each citizen; overcoming the shortcomings due to the weak position of consumers in the relationship with business organizations and individuals when conducting transactions; gradually equipping consumers with knowledge and skills to form consumer initiative.

In addition, the Law aims to ensure balance in civil transactions between consumers and business and production organizations and individuals, protect the legitimate rights and interests of consumers, and at the same time ensure the legitimate rights and interests of legitimate business organizations and individuals; strengthen the protection of consumer rights in cyberspace and cross-border transactions...

Regarding the rights and obligations of consumers, the Chairman of the Committee on Science, Technology and Environment said that, taking into account the opinions of National Assembly deputies, the draft Law has added a provision in Clause 10, Article 4 in the direction that when using public services, consumers are protected according to the provisions of this Law and other relevant laws.

At the same time, to prevent the provision of services that do not guarantee quality, the draft Law has added Article 36 on the responsibilities of business organizations and individuals in providing services (including public services) that do not comply with the registered, notified, announced, or contracted content.

In addition, the draft Law also adds Clause 5, Article 5 on the obligations of consumers, specifically: “Ensure accurate and complete provision of information related to transactions between consumers and business organizations and individuals. Be responsible for providing inaccurate or incomplete information according to the provisions of law”.

Consumer protection in specific transactions

Some opinions suggest that it is necessary to clarify the content and solutions to protect consumer rights in transactions on cyberspace, in order to ensure legitimate rights for participating parties, between sellers and buyers.

According to the Chairman of the Committee on Science, Technology and Environment, the draft Law has many specific provisions on protecting consumer rights in transactions between consumers and organizations and individuals doing business in cyberspace, such as regulations on transactions in cyberspace, transactions on digital platforms, regulations on general responsibilities of organizations and individuals doing business in cyberspace, specific responsibilities of organizations establishing and operating intermediary digital platforms, authenticating the identities of organizations and individuals selling goods and providing services on digital platforms, etc.

In addition, Chapter II of the draft Law also has provisions on the responsibility to protect consumer information, contract conclusion and termination, receiving and handling complaints, responsibility for defective products and goods, services that do not guarantee quality, are not as announced, etc.

In addition, this content is also regulated by the law on e-commerce as well as other relevant laws.

Regarding the activities of social organizations to protect consumer rights, the draft Law has many provisions to create conditions for social organizations to participate in protecting consumer rights (including the Consumer Protection Association), such as representing consumers to file lawsuits when requested and authorized or to file lawsuits themselves to protect consumer rights for the public interest...

At the same time, the draft Law has specifically regulated the activities of the Association when participating in protecting consumer rights and clearly classified the types of social organizations to have a basis for implementing the State's assigned tasks, financial support and other conditions according to the provisions of law.

Regarding dispute resolution at court, the National Assembly Standing Committee chose the option of clearly regulating the application of simplified procedures to resolve civil cases on consumer rights protection.

At the same time, to ensure that transactions of 100 million VND or more can still apply the simplified procedure prescribed in the Civil Procedure Code, the draft Law is amended in the direction that civil cases on consumer rights protection are resolved according to the simplified procedure prescribed in the law on civil procedures when meeting the provisions of Clause 1, Article 317 of the Civil Procedure Code or when meeting a number of specific conditions prescribed in the draft Law.

The Draft Law has reviewed, adjusted and perfected regulations to ensure balance of interests of business organizations and individuals in their relationships with consumers.

In addition, absorbing the opinions of National Assembly deputies, the draft Law has reviewed, adjusted and perfected regulations to ensure a balance of interests of business organizations and individuals in their relationships with consumers.

The draft Law on Consumer Rights Protection (amended) after being absorbed and revised includes 7 Chapters, 79 Articles; amending and supplementing 63 Articles (including Articles that are removed, transferred to other Articles, and supplementing 2 Articles), keeping 16 Articles and supplementing Clause 5 of Article 317 of the Civil Procedure Code to ensure the consistency and synchronization of the legal system related to consumer rights protection.

As expected, after being discussed by the National Assembly in the hall this morning, the draft Law on Consumer Rights Protection (amended) will be voted on and passed at the meeting on the afternoon of June 20.
