Ministry of Home Affairs implements the 2024 Law on Archives and documents guiding its implementation

BAC NINH - On September 19, the Ministry of Home Affairs held a conference to disseminate the 2024 Law on Archives and its implementing documents. The conference was held in person and online at the connecting points of ministries, branches, central agencies, People's Committees of provinces, cities, communes and wards.

The Law on Archives 2024 was passed by the 15th National Assembly of the Socialist Republic of Vietnam at the 7th session on June 21, 2024. The Law takes effect from July 1, 2025.

Based on the provisions of the 2011 Archives Law, the 2024 Archives Law focuses on clarifying four major policies: Authority to manage archival documents belonging to the National Archives of Vietnam; management of electronic archival documents to meet the requirements of digital transformation and e- Government development; management of private archival documents and management of archival service activities.

Specifically, the Law supplements regulations on the authority to manage documents of the National Archives of Vietnam in the direction of clearly defining the authority to manage archival documents and archival document databases between the Archives of the Communist Party of Vietnam and the Archives of the State of Vietnam; between the State archives at the central and local levels; decentralizing the authority to manage documents and archival document databases of the defense, public security, and Ministry of Foreign Affairs sectors. At the same time, specific regulations are made on the deadline for submitting files and documents to historical archives; regulations on archiving electronic documents and digital documents.

Regarding archival documents of special value, the Law identifies promoting the value of archival documents as an important goal and task of archival work serving the cause of national construction and defense, ensuring citizens' right to access information.

Regarding storage service activities, the Law regulates storage service activities and affirms that storage service activities belong to conditional investment and business sectors; at the same time, clarifies the scope of storage service provision by organizations and individuals; and the responsibilities of agencies, organizations and individuals for storage service activities.

The 2024 Archives Law also stipulates January 3rd of each year as Vietnam Archives Day. Thereby affirming the role and importance of archives and recognizing the merits and contributions of archival staff.

Also at the conference, delegates heard the deployment and introduction of an overview of new regulations of the legal system on archiving to meet the requirements of Resolution No. 57-NQ/TW, Resolution No. 66-NQ/TW, Resolution No. 68-NQ/TW of the Politburo; New regulations on archiving paper documents and documents on other information carriers; Regulations on Archiving Service Activities - Promoting the Value of Archival Documents - Vietnam Archives Day; New regulations on digital archiving and applying technology in performing archiving operations; Development of archival human resources.

Speaking at the conference, Comrade Cao Huy, Deputy Minister of Home Affairs, emphasized that the 2024 Archives Law is of great significance in modernizing archives and meeting the requirements of digital transformation. The Law supplements regulations on electronic documents with legal value, recognizes private archives, innovates archives operations and promotes the socialization of the archives sector, creating a new step forward in managing, protecting and promoting the value of national archives.

He noted that during the implementation of the Law, there will be problems arising, so sectors and localities need to listen to feedback and suggestions from those performing tasks related to archival work, thereby finding solutions to remove them, ensuring effective archival activities. Strengthen propaganda and dissemination of the Law's contents, promote the socialization of archival activities and promote the value of archival documents in practice.
