Regarding the draft Law on Personal Income Tax (amended), the Government agreed on the necessity of developing a draft law to continue institutionalizing the Party's guidelines and policies, the State's policies and laws on perfecting the tax policy system in general and the personal income tax policy in particular.
Managing personal income tax, collecting correctly, fully, promptly and equally
The Government assigned the Ministry of Finance to preside over and coordinate with relevant ministries and agencies to research and absorb as much as possible the opinions of Government members and the Prime Minister's conclusions, and complete the draft law to ensure requirements.
Continue to review the provisions in the draft to ensure consistency with the provisions of the Constitution and relevant legal provisions (Land Law, Securities Law, Social Insurance Law and laws on high technology...).
At the same time, meet the requirements to improve tax management, collect correctly, fully and promptly, while ensuring equal treatment among taxpayers.
Review and add income (severance pay, allowances, subsidies, living expenses paid by Vietnamese agencies abroad...) to the tax-exempt list. Complete the regulations on progressive tax schedules according to option 2 as proposed by the Ministry of Finance.
Carefully assess the impact of personal income tax regulations on business income to avoid major disruptions to people's business activities. Effectively implement the policy of eliminating tax collection for business households and business individuals according to resolutions.
Clearly define income from gold trading activities as taxable to enhance market transparency and limit gold speculation. Assign the Ministry of Finance to coordinate with the State Bank to unify this content in the draft law.
Further strengthen decentralization and delegation of power; in which the Government shall specify in detail the fluctuating issues to ensure flexibility in direction and administration.
Encouraging M&A activities in the high-tech sector with foreign companies
Regarding the Law on High Technology (amended), the Government requires creating breakthroughs and a legal corridor to form strong research groups (both domestic and foreign), encouraging mergers and acquisitions (M&A) of foreign companies holding core technology to take shortcuts and receive technology transfer.
Specific regulations are needed to ensure that preferential and support policies only apply to high-tech activities, research and development activities of strategic technologies, and serve the development of infrastructure and facilities directly serving high-tech activities.
In addition, the Government also gave opinions on the draft law amending and supplementing a number of articles of the Law on Environmental Protection; Law on Plant Protection and Quarantine; Law on Animal Husbandry; Law on Biodiversity; Law on Dikes; Law on Surveying and Mapping; Law on Hydrometeorology; Law on Forestry; Law on Natural Disaster Prevention and Control; Law on Water Resources; Law on Marine and Island Resources and Environment; Law on Veterinary Medicine; Law on Irrigation; Law on Fisheries; Law on Cultivation.
The Government agreed on the necessity of developing a draft law to institutionalize the Party's guidelines and policies, and the Government's direction on agricultural and rural development, natural resources and environmental management; to overcome difficulties and shortcomings in the process of implementing the law; to ensure compliance with organizational arrangement, streamlining the apparatus, and effective and efficient operations.
The development of this law must meet the requirements of Vietnam's practice and conditions regarding agricultural and rural development, natural resource and environmental management; selectively refer to international legal experience and practical work in agriculture, rural areas, natural resource and environmental management of a number of countries in the world.
