Can I stop paying unemployment insurance to receive benefits?

Ms. Lan Anh works at a private enterprise, has participated in social insurance (SI) for more than 27 years and paid unemployment insurance (UI) for more than 13 years.

Recently, Ms. Lan Anh learned that when employees quit their jobs, they can only receive a maximum of 12 months of unemployment benefits, corresponding to 12 years (144 months) of social insurance contributions. After receiving the maximum level of unemployment benefits, the period of social insurance contributions exceeding 144 months cannot be retained.

Therefore, Ms. Lan Anh asked: "Can I stop paying social insurance now to apply for unemployment benefits?"

According to Vietnam Social Security, if she is still working, Ms. Lan Anh is required to participate in unemployment insurance if she is eligible to participate according to Article 43 of the Law on Employment and cannot stop paying unemployment insurance to receive unemployment benefits. Specifically as follows:

Ms. Lan Anh can receive unemployment benefits if she meets the conditions for benefits as prescribed in Article 49 of the Law on Employment and guiding documents. Specifically as follows:

Vietnam Social Security instructs: "Thus, if you meet the above conditions, you will receive unemployment benefits. Please contact the local Employment Service Center where you need to receive unemployment benefits for support."
