Announcing the inspection conclusion related to the Investment and Construction Management Board of the New Urban Area in South Ho Chi Minh City

(NLDO) - The Southern Area Management Board has allowed many households to encroach on land to build housing projects on riverside land.

The Ho Chi Minh City Inspectorate has just announced the inspection conclusion on compliance with legal regulations in urban planning management, construction investment management and investment calling at the Investment and Construction Management Board of the New Urban Area in the South of Ho Chi Minh City (abbreviated as the Management Board of the South Area).

The Ho Chi Minh City Inspectorate assessed that in addition to the achievements, the New Urban Area of ​​the South of the City still has some shortcomings and inadequacies. Accordingly, there is no consistency between each type of approved project, the content of the approved planning project is not complete according to regulations, and there is no basis for comparing the suitability of each type of planning project.

The repeated adjustment of local planning of functional areas has led to fragmentation, lack of uniformity, and insufficient state-managed land fund; failure to ensure technical infrastructure and social infrastructure; there is still a situation of construction and land use in violation of planning, and land encroachment in canals, green parks, etc.

The rate of projects with land allocated and completed and put into use is low (only 04/97 projects account for 0.04%), most of the projects are not completed. The reason is that the compensation and site clearance work is slow, lasting from 2000 to present.

The Southern Area Management Board allowed a tennis court and a level IV house to be built without a permit in a park with approved planning.

Ho Chi Minh City Inspectorate concluded through inspection work that there were 9 agencies and units with shortcomings and violations related to 28 contents.

In particular, the Southern Area Management Board has allowed the construction of internal roads adjacent to existing canals (behind Lot M9 to Lot S15) and many households have encroached to build housing projects on riverside land, allowing the South Saigon International School (building blocks A3, A6) to be built without permission on a large scale (total illegal construction area of ​​about 9,948.575m²).

The Southern Area Management Board allowed a tennis court and a level IV house to be built without a permit in the approved planning park at Lot R11-14-17; allowed construction on the setback and construction of a corrugated iron roof on the setback at Lot H6 and H7.

Also according to the inspection conclusion, the Southern Area Management Board did not monitor and request Phu My Hung Company to invest in building a green park in the green park land area of ​​lot CR8 according to the approved planning.

The Southern Area Management Board also delayed in coordinating with relevant units to urge investors to fulfill financial obligations related to the construction of inter-connected basements beyond the project land allocation boundary at Lots M5, M6, M7, M8.

This unit proposed to remove 2 projects (Functional Area No. 19 Project in An Phu Tay Commune, Binh Chanh District and Phong Phu Residential Area Project in Functional Area No. 15 in Phong Phu Commune, Binh Chanh District) from the investment promotion list in 2022 but did not explain the reason. According to the Ho Chi Minh City Inspectorate, this does not fully ensure the basis for consultation and proposal and is likely to affect the progress of attracting investment capital for the project.
