Proposal to establish an agency to protect online shoppers
Commenting on the draft Law on E-commerce, some National Assembly deputies proposed that there should be a specific agency or organization to handle disputes and complaints if they arise between online buyers and sellers.
Accordingly, delegates recommended the need for an independent e-commerce dispute resolution agency or the establishment of an electronic arbitration system with simple procedures, low costs and the ability to quickly enforce decisions. In addition, there was also a proposal to add e-commerce platforms and livestream platforms to be responsible for proactively compensating for damages, in case the promoted products are determined to be counterfeit or harmful to consumers.
Deputy Minister of Industry and Trade Nguyen Sinh Nhat Tan said that regarding consumer protection and handling of counterfeit goods, the amended Law on Consumer Protection has come into effect and the draft Law on E-commerce has reinforced the content of handling counterfeit goods and infringement of intellectual property rights. The Ministry of Industry and Trade would like to accept and supplement the regulations for completeness.
Regarding the proposal to establish an independent agency to resolve disputes, Deputy Minister Tan emphasized that the Ministry of Industry and Trade is implementing Resolution 18 and carefully considering the establishment of a new agency. Instead, the ministry will use the old apparatus (Department of E-commerce and Digital Economy ) to carry out state management and to act as a liaison to resolve disputes between consumers and businesses. Dispute resolution will apply four methods stipulated in the Law on Consumer Protection (negotiation, conciliation, arbitration and going to court).
The Ministry of Industry and Trade accepts opinions on transferring the responsibility of controlling and supervising part of the responsibility to the floor owner and reinforces to clarify the responsibility of the third party (floor, livestream).
Concluding the discussion, Vice Chairman of the National Assembly Vu Hong Thanh acknowledged and highly appreciated the full and responsible participation of the delegates.
The drafting agency urgently coordinates closely with the reviewing agency and relevant agencies to continue reviewing, maximally absorbing and fully explaining the opinions of National Assembly deputies at the conference and technical issues to complete the draft law.
