Proposal to amend 4 laws, increase decentralization to localities to speed up project construction

On September 11, in Ho Chi Minh City, the Ministry of Planning and Investment held a workshop to collect opinions from provinces and cities in the Southeast region and the Mekong Delta region on the draft Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding.

Regarding the Law on Planning, the Ministry of Planning and Investment said that this law will be amended in the direction of perfecting regulations on the national planning system and amending the content of provincial planning to avoid duplication between provincial planning and urban and rural planning. At the same time, decentralization and delegation of authority will be strengthened, and procedures will be simplified.

Regarding the Investment Law, the Ministry of Planning and Investment also proposed amendments to promote decentralization of investment policy approval to provincial People's Committees, supplement regulations on the establishment of Investment Support Funds and amend regulations on the termination of investment projects, and supplement regulations on special investment procedures for investment projects in a number of priority areas for investment attraction.

Regarding the Law on Investment under the public-private partnership method, the Ministry of Planning and Investment said that in order to remove difficulties and obstacles, and continue to perfect a favorable legal framework to attract investment under the PPP method (public-private partnership), this law amends and supplements a number of articles.

In particular, this ministry proposed expanding and diversifying the fields, forms and methods of implementing PPP projects, and perfecting the financial mechanism for PPP projects.

The Ministry of Planning and Investment proposed simplifying procedures, promoting decentralization of state management of PPP projects and thoroughly handling difficulties and problems for transitional BOT and BT projects.

Regarding the Law on Bidding, the Ministry of Planning and Investment also proposed simplified regulations to create favorable conditions to save time and speed up the implementation of projects and bidding packages.

Notably, the ministry proposed adding bid packages that apply the form of contractor selection in special cases, and at the same time decentralizing the authority to decide on applying this form to speed up the implementation progress of projects and bid packages...

Amending laws to promote economic growth

Deputy Minister of Planning and Investment Nguyen Thi Bich Ngoc said that the implementation of policies and laws on planning and investment in practice has revealed many shortcomings, causing obstacles and difficulties.

Therefore, the Ministry of Planning and Investment has reviewed and submitted to the Government a proposal to develop a draft Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding to handle problems in the implementation process.

Thereby, contributing to removing difficulties and bottlenecks in planning, investment, production and business activities, promoting economic growth.
