ANTD.VN - The Ministry of Finance proposed a regulation that invoices must show the buyer's identification code, but the Vietnam Federation of Commerce and Industry (VCCI) said that this regulation is difficult to implement.

There are many conflicting opinions about regulations related to invoices.

The Ministry of Finance is seeking comments on the draft Decree amending and supplementing a number of articles of Decree 123/2020/ND-CP regulating invoices and documents.

Article 1.6.b of the draft (amending Article 10.5 of Decree 123/2020/ND-CP) stipulates that the invoice must show the buyer's identification code.

Regarding this regulation, VCCI said that businesses consider it unfeasible because requiring buyers to declare information about identification codes will be a "blocking point", causing buyers to not want to get invoices because they do not want to declare this information.

Second, the seller does not have a mechanism to confirm whether the identification code provided by the buyer is correct or not, whether it meets the conditions of "legal identification code and electronic authentication" or not to show on the invoice.

This will pose risks to businesses when issuing invoices. Therefore, businesses request the drafting agency to reconsider this regulation.

Regarding the regulations on issuing invoices for passenger transport businesses using taxis with fare calculation software in Article 1.5.b of the Draft (amending Article 9.4 of Decree 123/2020/ND-CP), VCCI believes that the regulation on sending taxi invoice data to tax authorities after each trip, according to businesses' feedback, may lead to some difficulties in the actual implementation process.

For example, the cost of upgrading taxi companies' software increases, taxi drivers forget/have difficulty performing operations, leading to traffic jams, etc.).

In that case, businesses may be fined for transferring data at the wrong time. Therefore, it is recommended that the drafting agency consider amending the above regulation to facilitate businesses in their operations.
