Hotels in Nha Trang violated construction regulations and built extra floors: Who is responsible?

53 hotels violated regulations by building extra floors and arbitrarily changing functions.

As Thanh Nien reported, according to the report of the functional sector, in Khanh Hoa province there are a total of 67 constructions violating construction, of which in Nha Trang city alone there are 53 hotels violating the construction of extra floors, creating mezzanines, basements, and arbitrarily changing the function. Up to now, most of these violations have not been remedied even though they have paid fines.

Nha Trang City has a series of hotels violating construction regulations.

Of the 67 violating constructions, 40 were licensed by the Department of Construction, and the remaining 27 were licensed by the District People's Committee and the Van Phong Economic Zone Management Board.

Previously, on November 20, 2023, in a document sent to the Department of Construction and related units and localities, Vice Chairman of Khanh Hoa Provincial People's Committee Tran Hoa Nam requested to urgently inspect and strictly handle construction works that violate construction order according to the provisions of law. At the same time, it is not allowed to repeat violations in new construction works.

The Vice Chairman of Khanh Hoa Provincial People's Committee also assigned the Department of Construction to synthesize and report the implementation results to the Provincial People's Committee before December 29, 2023. However, more than 10 days have passed since the deadline, but Khanh Hoa Department of Construction has not yet sent a report to the Provincial People's Committee.

Ton Dan Street, Loc Tho Ward is less than 200 meters long and only about 3 meters wide but is densely packed with hotels. There are 5 hotels here that violate construction regulations.

Speaking with Thanh Nien , Mr. Le Minh Tien, Deputy Director of Khanh Hoa Department of Construction, said that due to the large volume of construction projects spanning many different periods and stages, the Department has sent a document requesting permission from the Provincial People's Committee to extend the reporting time.

When asked by Thanh Nien reporter whether the investor is required to fix or dismantle the violating parts, Mr. Tien said that this must be reviewed for each construction and project before specific handling measures can be taken. However, according to regulations, violating constructions will be forced to fix but must follow the prescribed order and time. "After the inspection and handling results are available, the department will provide specific information," Mr. Tien said.

Speaking to Thanh Nien reporter, Mr. Tran Hoa Nam, Vice Chairman of Khanh Hoa Provincial People's Committee, said that for violating constructions, the province has directed to strictly handle them according to the law. "Depending on the level of violation in each construction, it will be forced to dismantle and fix it," Mr. Nam emphasized.

According to the Vice Chairman of Khanh Hoa Provincial People's Committee, the responsibility for this violation belongs to many different management levels, from the investors of urban areas, the district People's Committee to the Department of Construction. "The specific responsibility has not been answered yet. That will be a separate matter after there is a report on the results of the inspection and handling of violating constructions," said Mr. Nam.

Previously, Thanh Nien reported that the functional sector of Khanh Hoa province inspected fire prevention and discovered a series of hotels in Nha Trang City that were converted from houses and built extra floors. These buildings were mostly hotels and restaurants.
