Before voting, the National Assembly listened to Chairman of the National Assembly's Committee on Culture and Education Nguyen Dac Vinh present a report on receiving, explaining and revising the draft Law on Cultural Heritage (amended).
The draft Law on Cultural Heritage (amended) approved by the National Assembly consists of 9 Chapters and 95 Articles, regulating cultural heritage, management, protection and promotion of cultural heritage values; rights, obligations and responsibilities of agencies, organizations, communities and individuals in management, protection and promotion of cultural heritage values of the Socialist Republic of Vietnam.
Compared with the current Law, the Draft Law on Cultural Heritage (amended) has 9 new points such as: specific regulations on the establishment of cultural heritage according to each type of ownership: public ownership, common ownership, private ownership in accordance with the Civil Code and other relevant legal provisions; regulations on State policies in activities of protecting and promoting the value of cultural heritage, prioritizing State budget allocation for specific activities; training and fostering human resources participating in the management, protection and promotion of the value of cultural heritage.
The Draft Law also completes prohibited acts to ensure more accuracy and completeness, serving as a basis for guiding implementation, inspection, and handling of violations in protecting and promoting the value of cultural heritage; specifically identifies cases of adjusting the protection boundaries of relics, world heritage areas, and buffer zones of world heritage; stipulates principles and authority to adjust the boundaries of protected areas to ensure feasibility when applied in practice;
Specify the repair, renovation, and construction of works and individual houses inside and outside the relic protection area; regulations on the management of national relics, antiquities, and treasures; handling discovered and handed over relics and antiquities; supplement the Cultural Heritage Conservation Fund; prescribe policies to protect and promote the value of documentary heritage; supplement policies to support the development of the museum system.
The subjects of application of the Law include agencies, organizations, communities and Vietnamese people residing in Vietnam; agencies, organizations, communities and foreigners residing and operating in Vietnam; Vietnamese people residing and operating abroad related to the management, protection and promotion of cultural heritage values.
The Law clearly states that the State plays a leading role in ensuring and developing activities to protect and promote the value of cultural heritage; mobilizing social resources for activities to protect and promote the value of cultural heritage of regions, areas, and ethnic groups;
At the same time, prioritize the allocation of the State budget for activities to protect and promote the values of cultural heritages that have been listed or recognized by UNESCO; protect and promote the values of the languages and scripts of Vietnamese ethnic groups; protect and promote the values of cultural heritages in ethnic minority, mountainous, border and island areas...
The Law stipulates that the Cultural Heritage Conservation Fund is a non-budgetary State financial fund, established and operating in accordance with the provisions of law to support funding for activities to protect and promote the value of cultural heritage that has not been invested in, supported, or invested in sufficiently by the State budget (protecting intangible cultural heritage at risk of fading or being lost; carrying out projects and items to preserve, renovate, restore, protect and promote the value of relics; purchasing and bringing relics, antiques, national treasures, documentary heritage, rare documents on intangible cultural heritage of Vietnamese origin from abroad to the country...).
The Law assigns the Ministry of Culture, Sports and Tourism as the focal point to assist the Government in unified State management of cultural heritage. At the same time, it requires Ministries and ministerial-level agencies, within the scope of their tasks and powers, to coordinate with the Ministry of Culture, Sports and Tourism in performing the task of State management of cultural heritage according to the provisions of this Law and other relevant legal provisions.
The Law on Cultural Heritage (amended) will take effect from July 1, 2025.
