The name "Miss Sea Vietnam" became noisy because of the dispute between two units: Phuong Nam Design and Training Joint Stock Company and Hoang Duy International Entertainment Media Company Limited.
Noisy dispute just because of the name
In recent days, the controversy over the name Miss Sea Vietnam between the two above units has caused a stir on social networks.
Mr. Ly Minh Tuan - representative of Phuong Nam Company said he had sent a petition to the Ministry of Culture, Sports and Tourism and relevant authorities to confirm that he is the author and legal owner of the name "Miss Sea Vietnam".
Mr. Tuan also filed a complaint with the Department of Culture, Sports and Tourism of Binh Thuan against the approval for Hoang Duy Company to organize a contest with a similar name.
According to Mr. Tuan, the Miss Sea Vietnam contest was organized by his company in 2016 and 2018 in Quang Ninh and Kien Giang .
"We registered the name of the Miss Sea Vietnam contest for intellectual property rights with the Intellectual Property Office in 2015 and announced it in 2016," Phuong Nam said.
According to Mr. Tuan, the fact that another unit - Hoang Duy International Entertainment Media Company Limited - organized the Miss Sea Vietnam 2024 contest taking place at the end of December this year in Binh Thuan is a violation of the copyright ownership of the name.
Meanwhile, Hoang Duy Company believes that the name "Miss Sea Vietnam" is not subject to exclusive protection and all organizations and individuals have the right to use it according to the law.

According to a search from the Intellectual Property Office, Phuong Nam Company has registered the trademark as the Miss Sea Vietnam logo but in a comprehensive form including image, color and design.
Therefore, the name "Miss Sea Vietnam" is not exclusively protected as a trademark. Any organization or individual has the right to use the name, as long as it does not infringe on other legitimate rights.
"The fact that Phuong Nam Company owns the Miss Sea Vietnam trademark in its entirety (including the crown image) and Hoang Duy Company owns the Miss Sea Vietnam logo are two completely separate and transparent issues, with no infringement of intellectual property rights between the two parties," Hoang Duy said.
This unit carried out registration procedures with the Department of Culture, Sports and Tourism of Binh Thuan province to organize the contest and was approved by the Department under License No. 85/SVHTTDL-QLVHGĐ dated August 14, 2024.
Mr. Trung Hoang, the company representative, affirmed that the recent accusations about Hoang Duy Company violating intellectual property rights without sufficient legal basis and spreading false information affecting the legal rights and interests of the unit.
This behavior not only creates unnecessary controversy but also damages the reputation of the Miss Sea Vietnam 2024 contest, especially during the preparation stage for the final round.
Hoang Duy requested Phuong Nam Company to stop spreading false information lacking legal basis related to the intellectual property rights of the Miss Sea Vietnam 2024 contest; at the same time, it needs to correct and publicly apologize to the company for the false information it has provided.
"In case Phuong Nam Company and related individuals and organizations do not have goodwill to cooperate to resolve the issue, we will apply legal measures to ensure rights," responded a representative of Hoang Duy Company.
