South Korean President Yoon Suk Yeol's legal team filed a complaint on January 16 accusing the police and anti-corruption agency leaders of illegally entering the presidential residence.
Yonhap reported that Mr. Yoon's legal team filed complaints against the head of the Corruption Investigation Office (CIO) of South Korea, Oh Dong-woon, the head of the National Office of Investigation (NOI), Woo Jong-soo, and several other individuals.
The lawyers accused the named people of illegally entering the presidential residence and executing the arrest warrant for Mr. Yoon, saying that these constituted the crimes of rebellion, obstruction of official duties and violation of military secrets. Korean law stipulates that the presidential residence is considered a secret military facility.

"They mobilized more than 3,700 police officers to invade the palace and arrest the president, violating the provisions of the criminal procedure law," Mr. Yoon's lawyer argued.
Also on January 16, the Seoul Central District Court began reviewing the legality of the arrest warrant for President Yoon Suk Yeol. After CIO investigators arrested Mr. Yoon on January 15 to investigate charges of rebellion over the decision to declare martial law in early December 2024, the president's lawyers filed a petition with the court requesting an assessment of this decision.
During the review process, the 48-hour detention period for Mr. Yoon was postponed from around 2 p.m. on January 16 (local time) when investigators submitted documents to the court. The postponement lasted until the court returned the case to the investigation agency. On the second day of questioning (January 16), the lawyer said that President Yoon did not appear due to health problems, and clearly explained his position on January 15, although Mr. Yoon had previously requested to postpone the questioning from the morning to the afternoon.
Mr. Yoon's side objected to the CIO's investigation, arguing that the agency had no jurisdiction, while the CIO stressed that the court's approval of the arrest warrant affirmed its authority.
