Reporting at the meeting, Deputy Minister of Agriculture and Environment Nguyen Hoang Hiep said that the draft Decree focuses on two groups of policies related to land and environment.
Notably, the draft Decree unanimously assigns the Chairman of the Provincial People's Committee to be the focal point in deciding on land allocation; land lease; change of land use purpose, extension, adjustment of land use period; and issuance of land use right certificates and ownership of assets attached to land for the first time.
In addition, the investment registration certificate is considered an important legal basis when requesting land allocation, lease, or change of land use purpose. This is a new point to create maximum convenience for investors - Deputy Minister Nguyen Hoang Hiep emphasized.
Regarding environmental policy, the draft Decree stipulates that investment projects only need to register technology and register for the environment and there will be specific instructions on the content of the registration documents and the time of receipt. The receiving agency is the People's Committee at the commune level - this regulation is in accordance with the Law on Environmental Protection. In addition, investors can choose to register directly with the management agency of the International Financial Center. This is an expansion point, creating convenience compared to current regulations.
During the process of drafting the Decree, there are still a number of issues that need to be consulted regarding specific regulations on land and environmental supervision; refunding investors' advances for infrastructure construction; and mortgaging land use rights at foreign banks.
To avoid the situation where many decrees guide the same thing or have important contents but no guidance, Deputy Minister Nguyen Hoang Hiep said that it is necessary to build a comprehensive set of draft Decrees guiding the implementation of Resolution No. 222/2025/QH15 and have a 'common arbitrator'; proposed that the Ministry of Justice should step in to closely review and ensure consistency of regulations.
Contributing opinions to the draft Decree, leaders of the People's Committees of Ho Chi Minh City and Da Nang City hoped that the drafting agency would continue to make technical adjustments to a number of regulations related to the organization of auctions and bidding to select investors; environmental registration; and at the same time, clarify the legal basis of the regulation that considers the investment registration certificate as the basis for allocating, leasing, and changing land use purposes...
Representatives of the Ministry of Justice, the Ministry of Construction, and the Ministry of Finance discussed and gave opinions on the basis for promulgating a superior and specific mechanism for the International Financial Center in Vietnam; the scope of regulation, especially in the construction sector; the right to own houses of foreigners in the central area; allowing investors to implement projects based on economic-technical reports instead of feasibility study reports...
Concluding the meeting, Deputy Prime Minister Tran Hong Ha noted that some contents related to investment procedures (as prescribed by the Investment Law) such as auction, bidding, investor selection processes, etc. need to be amended when amending the law. Therefore, the Deputy Prime Minister assigned the Ministry of Finance to absorb and coordinate with ministries and branches to include them in appropriate documents. Regarding issues in the financial sector, the Ministry of Finance will take the lead in drafting guiding decrees.
Regarding regulations on environmental registration, the Deputy Prime Minister requested to clarify the registration procedure, in the direction of having both online and direct forms at the commune level; at the same time, notify the management agency of the International Financial Center to monitor and "have the right to stop if detecting that the investor's registration is not in accordance with regulations".
The Deputy Prime Minister said that if only referring to current laws, the specificity and prominence of the International Financial Center would be lost; therefore, the Ministry of Agriculture and Environment needs to conduct more research to propose a superior mechanism. For contents that go beyond the law and resolutions, the Government needs to seek opinions from the National Assembly Standing Committee before promulgating.
Regarding construction management policy, the Deputy Prime Minister assigned the Ministry of Construction to propose regulations allowing investors to prepare economic-technical reports or design-technical-construction reports instead of having to go through many levels such as pre-feasibility studies, feasibility studies..., in order to reduce procedures and conform to international practices.
Regarding regulations on mortgaging land use rights at foreign banks, the Deputy Prime Minister requested compliance with current laws on land use rights and assets attached to land.
The Deputy Prime Minister also requested the Ministry of Agriculture and Environment, the Ministry of Construction, and the Ministry of Finance to promptly absorb and complete the draft Decree, submit it to the Government for comments, and report to the National Assembly Standing Committee before the Prime Minister signs it for promulgation.
