According to the 2023 Law on Identification, people who want to be issued a new identification card due to gender reassignment or gender change must present a number of documents and papers.
On June 24, Ho Chi Minh City Police and Hanoi City Police announced a temporary suspension of issuing Citizen Identification Cards in the area from June 25 to June 30. This is to prepare for the conditions for granting ID cards to citizens according to the ID Law No. 26/2023/QH15, effective from July 1, 2024. From July 1, the functional forces of Hanoi City Police and Ho Chi Minh City Police continue to receive and issue ID cards to citizens according to regulations. Cases of issuing and exchanging ID cards According to Article 24 of the 2023 ID Law, cases of issuing and exchanging ID cards include: Vietnamese citizens who have been issued ID cards must carry out procedures for issuing and exchanging ID cards when they are 14, 25, 40 and 60 years old. Change or correct information about last name, middle name, birth name; date, month, year of birth. Change identity; add information about facial photos, fingerprints; re-identify gender or change gender according to the provisions of law. There are errors in the information printed on the ID card. Re-establish personal identification number. At the request of the ID card holder when the information on the ID card changes due to administrative unit arrangement. When the ID card holder requests. In addition, from July 1, 2024, citizens under 14 years old will also be issued an ID card if needed. The time limit for issuing, exchanging and reissuing ID cards is stipulated within 7 working days from the date of receiving complete documents.

The order and procedures for issuing, exchanging, and reissuing ID cards are specified in Article 25 of this Law. Accordingly, in cases of issuing and reissuing ID cards due to gender reassignment or gender change or changes or corrections to information specified in Point b, Clause 1, Article 24 of this Law, but such information has not been updated or adjusted in the National Population Database, the person requiring an ID card must present legally valid documents and papers proving the changed information to carry out the procedure for updating and adjusting information in the National Population Database. The ID management agency shall collect the citizen ID card and used ID card in cases of issuing and reissuing ID cards. Validity period of old identity cards and identification cards Article 46 of the 2023 Law on Identification clearly stipulates: Citizen identification cards issued before the effective date of this law are valid until the expiry date printed on the card, except for the case specified in Clause 3 of this Article. Citizens, when in need, will be issued a replacement for an identity card. Identity cards that are still valid after December 31, 2024 will be valid until December 31, 2024. Legal documents that have been issued and use information from identity cards and citizen identification cards will retain their validity; State agencies are not allowed to request citizens to change or adjust information about identity cards and citizen identification cards in issued documents. Citizen identification cards and identity cards that expire from January 15, 2024 to before June 30, 2024 will continue to be valid until June 30, 2024. Regulations on the use of citizen identification cards and identity cards in legal documents issued before the effective date of this law shall be applied as for identity cards prescribed in this law until such legal documents are amended, supplemented or replaced.
