Kinhtedothi-On the morning of November 19, the Hanoi People's Council passed a Resolution regulating the concession of exploitation and management of valuable architectural works and cultural and sports infrastructure works and items under the management of Hanoi according to points a and b, clause 4, Article 41 of the Law on the Capital.

Franchising of exploitation and management of valuable architectural works

The purpose of the resolution is to regulate the concession of exploitation and management of valuable architectural works and cultural and sports infrastructure works and items under the management of Hanoi City in order to effectively implement the provisions of the Capital Law, improve the efficiency of public asset exploitation, especially cultural and sports infrastructure works and valuable architectural works under the management of the city; and ensure thrift practice, combat waste, develop cultural industry, and maximize the historical, landscape, cultural and tourism values ​​of the works.

The Resolution consists of 5 Chapters, with 25 Articles, which stipulates the subjects of application including 3 groups: agencies, organizations, units under the management scope of the city assigned to manage and use works and construction items with concessions for exploitation and management (collectively referred to as agencies, organizations, units); enterprises, organizations, and individuals receiving concessions for exploitation and management of 6 works and construction items as prescribed in this Resolution (collectively referred to as enterprises and investors); other subjects related to the management, use, and exploitation of works and construction items with concessions for exploitation and management.

Presenting the report of the City People's Committee, Director of the Department of Finance Nguyen Xuan Luu said that cultural - sports infrastructure works and valuable architectural works under the management of the city are public assets assigned to many subjects for management and use (State agencies, public service units, political - social organizations).

According to the provisions of law on management and use of public assets, only public service units are allowed to use public assets for business purposes, leasing, joint ventures, and associations when not yet fully utilized.

However, in reality, the implementation of using public assets for business, leasing, joint ventures and associations faces many difficulties due to the need to prove that the full capacity has not been used; economic efficiency is not achieved when developing the Project (high land rental costs, asset depreciation). At the same time, the process of developing, appraising and submitting for approval of the project has many procedures and is lengthy.

According to the provisions of Article 41 of the Capital Law, the implementation of exploitation and management concessions is a new method of exploitation, encouraging socialization to diversify resources to maintain, develop, and exploit public assets, improve efficiency, and avoid waste in the management and use of public assets at agencies, organizations, and units.

Therefore, the issuance of regulations on the concession of exploitation and management of valuable architectural works and cultural and sports infrastructure works and items under the management of Hanoi City (implementing Clause 4, Article 41 of the Law on the Capital) is necessary, contributing to practicing thrift, combating waste, and promoting the efficiency of resources from public assets.

Approve regular expenditure tasks of the city budget

Also at the meeting, the Hanoi People's Council passed a Resolution on the authority to decide and approve tasks and estimates of regular city budget expenditures to purchase assets and equipment to serve the operations of agencies and units under the management of Hanoi city.

Accordingly, the Resolution has decided that for the regular expenditure budget allocated by the city budget to implement autonomy of agencies and units (according to the Government's regulations on autonomy and self-responsibility for using payroll and administrative management budget for State agencies and financial autonomy mechanism of public service units), the head of the budget-using unit decides to approve the tasks and budget estimates for purchasing assets and equipment to serve the operations of his/her agencies and units.

For regular expenditure funds from the city budget that are not assigned to implement the autonomous regime, the heads of agencies and units that are level 1 budget units under the city level decide to approve the tasks and budget estimates for purchasing assets and equipment to serve the operations of budget-using units belonging to or directly under their agencies and units.

The Chairman of the People's Committee of the district, town or city decides to approve the tasks and budget estimates for the purchase of assets and equipment to serve the operations of agencies and units that are budget units at the district, town or city level.

The Chairman of the People's Committee of the commune or town decides to approve the tasks and budget estimates for the purchase of assets and equipment to serve the operations of agencies and units under the commune or town level.

Reviewing the content of the submission, the Economic - Budget Committee agreed with the content on decentralization and authorization of purchasing decisions of agencies and units as resolved by the City People's Council; consistent with the actual situation and requirements of financial and public asset management in the city; consistent with the policy and principles of promoting decentralization and delegation of power, creating initiative for agencies and units in implementing the preparation, management and use of the city's state budget estimates.
