Tighten management of cosmetic facilities in Da Nang

In Da Nang , the number of establishments providing cosmetic services is increasing. However, many establishments without licenses and without ensuring conditions are still openly operating and advertising loudly.

Activities exceeding the practice certificate

In mid-August, authorities discovered many violations at Kangzin Beauty Salon (368 Hung Vuong, Vinh Trung Ward, Thanh Khe District, Da Nang City). Authorities caught a janitor red-handed performing a facelift on a customer.

Also during this time, Thanh Khe District Police (Da Nang City) received 17 complaints from people about Wonjin Beauty Salon (used to operate at 218 Nguyen Tri Phuong, Thanh Khe District). Previously, since June, many customers suddenly lost contact with the staff of Wonjin Beauty Salon. When they went directly to the facility, they discovered that the place had changed its name to New York US Beauty Salon and changed its owner. Many people said they had paid 50-60 million VND for beauty services, including invasive services, at this beauty facility.

According to Ms. Hoang Thi Viet Nga, Captain of the Economic - Environmental Police Team of Thanh Khe District Police, most of the beauty salons in Thanh Khe District are business households with skin care certificates recognized by the Department of Health as establishments that meet the business conditions according to that practice certificate. However, in reality, the establishments perform activities beyond the practice certificate such as surgery, botox injections... Skin care practice certificates are not allowed to perform activities that deeply interfere with the human body such as injectable anesthesia. These activities can only be performed in clinics or hospitals with dermatology and cosmetic specialties with many procedures and require doctors with degrees.

The most common mistakes that establishments make are advertising on social media. For example, naming a business as a beauty salon is against the rules, because a beauty salon must be a dermatology clinic with accompanying procedures. The establishments also advertise services that exceed the permitted certification.

Establishments that advertise services beyond their permitted functions

With just a skin care certificate, many spa and beauty establishments have accepted students for training.

Most of the establishments in Thanh Khe district do not classify waste and do not sign waste classification contracts with establishments licensed to collect hazardous waste. Through inspection, the establishments collect all waste in normal garbage collection bags and leave them in front of the establishments, causing harm to the environment.

According to Ms. Nga, the above acts are all subject to administrative penalties, each facility can be fined over 100-200 million VND.

Increase decentralization and delegation of authority

Mr. Nguyen Ngoc Thanh, Head of the Department of Health (Da Nang Department of Health) said that there are currently about 500 cosmetic service establishments in Da Nang. Of which, Hai Chau district has about 300 establishments, Thanh Khe district has about 150 establishments, the rest are scattered in other districts.

However, out of 500 establishments, there are only about 28 specialized cosmetic establishments. Many current cosmetic service establishment owners do not clearly understand what a cosmetic service establishment is, what a specialized cosmetic clinic is - a place that requires a specialist doctor, who has been strictly evaluated to be able to perform services.

“In a beauty service facility that combines skin care, weight loss, tattooing, hair washing, etc., this is something that makes it difficult for the authorities to manage and inspect. We have made suggestions that the upcoming Law on Medical Examination and Treatment should clarify what is a beauty service and a specialized beauty facility,” said Mr. Thanh.

The inspection results in early 2023, the unit inspected about 20 establishments, the total amount of fines for the establishments was about 480 million VND. However, the current difficulty is coordinating with the locality to detect establishments that do wrong. Each district and county health department currently has only 1 to 3 people and does a lot of work. Meanwhile, the number of cosmetic establishments in many districts is very large. Meanwhile, there is still no specific decentralization for localities such as communes and wards in the management of cosmetic establishments.

Referring to this issue, Mr. Nguyen Huu Cong, Vice Chairman of Thanh Khe District People's Committee, said that Thanh Khe District has nearly 150 cosmetic service establishments, of which 119 have not yet announced their eligibility to operate, accounting for more than 80%. Regarding establishments that have not yet announced their eligibility to operate, according to Mr. Cong, the responsible departments and units will increase the provision of information and procedures for cosmetic establishments. In addition, the management and inspection of nearly 150 establishments with difficulties in the district will be divided among the People's Committees of the wards. Localities will not allow unqualified cosmetic establishments to operate. If any establishment that has not yet met the eligibility to operate has any problems, the local leaders will be responsible. By the end of September, if any establishment has not yet announced its eligibility, the District Health Department and Police will inspect and temporarily suspend its operations.
