In December 2023, implementing the Land Auction Project on a 5.4-hectare land plot in Thanh To Ward, Hai An District (now Hai An Ward), the locality had to implement a decision to enforce compulsory inventory for 15 households that had not complied with the inventory and inventory to carry out site clearance work.
During the land recovery process, there were cases where land users did not cooperate. Therefore, the authorities had to enforce the decision to conduct compulsory inventory and enforce land recovery.
In reality, many projects have been delayed due to these problems. In the past, implementing the provisions of the Land Law, land acquisition had to follow many steps and stages, including: developing and implementing a land acquisition plan; investigating, surveying, measuring, and counting land; establishing and appraising compensation, support, and resettlement plans... The above steps were only carried out after the project was approved and the investor was selected.
To make a decision on enforcement and organize enforcement, it is necessary to go through many procedures, prolonging the time to carry out land inventory and recovery. According to Deputy Director of the Department of Agriculture and Environment Duong Dinh On, the problem in site clearance is a "bottleneck", affecting the progress of project implementation, especially projects with large land use scale. Therefore, there needs to be a mechanism to speed up the progress of project site clearance.
Through the process of coordinating with localities to carry out site clearance work, the Department of Agriculture and Environment advised the city on proposing the National Assembly and the Government to allow the city to pilot a special mechanism on site clearance. Accordingly, state agencies will carry out inventory and measurement before selecting project investors.
After selecting an investor, land recovery and site clearance procedures are implemented according to the provisions of the Land Law, but land and property attached to the land are not re-measured and counted, only data is updated (if any).
This ensures the rights of land users because information on land and assets on land must be accurate, which can shorten the time for investment preparation procedures by about 5-6 months.
Early implementation of specific mechanisms

Resolution 226/2025/QH15 of the National Assembly pilots a number of specific mechanisms and policies for the development of Hai Phong city, which decentralizes the City People's Committee to implement procedures for land recovery for industrial park projects, high-tech parks, and concentrated information technology parks with an area of more than 100 hectares; industrial clusters, investment projects in economic zones, and logistics centers with an area of more than 50 hectares; and logistics services with an area of up to 50 hectares. In addition, there are investment projects in free trade zones; projects in which compensation, support, and resettlement are separated into independent projects according to the law on public investment.
According to this mechanism, the City People's Council issues a list of projects to be implemented before investigating, surveying, measuring, counting, and verifying the origin of land and assets attached to land. When organizing the task of compensation and site clearance, the local government shall follow the list issued by the City People's Council.
The preparation, appraisal, approval and implementation of compensation, support, resettlement plans and land recovery decisions shall comply with the provisions of the law on land.
After selecting an investor to implement the project in accordance with current law, the competent state agency shall reclaim land in accordance with the provisions of the Land Law, issue a notice of land reclamation and use the results of investigation, survey, measurement, inventory, and verification of the origin of land and assets attached to land carried out in accordance with regulations to develop a plan for compensation, support, and resettlement.
Currently, the Department of Agriculture and Environment is urgently completing the dossier to submit to the City People's Committee, then submitting to the City People's Council to issue a Resolution regulating the order and procedures for conducting investigation, survey, measurement, counting, and verification of the origin of land and assets attached to land before the competent state agency issues a notice of land recovery to implement a number of projects according to specific mechanisms and policies in the city.
The pilot implementation of decentralized site clearance to ensure progress of large projects is a condition for Hai Phong city to speed up the progress of investment projects.
