In Ea Drang Town (Ea H'leo District, Dak Lak ), there is currently an illegal construction project owned by Mr. Phan Dinh Thang (38 years old, director of a real estate company headquartered in Ea H'leo District).

According to Thanh Nien reporters, this project is located on an area of ​​about 2,000 m2 in Residential Group 3, Ea Drang Town, adjacent to Ea Drang irrigation lake, which has a very beautiful location. Surrounding the project is a solid fence higher than 2 m, inside there are built functional houses, swimming pools, internal concrete roads... with the tendency to be an entertainment spot.

A resident of Ea Drang town said the above construction was illegally built in 2022. As soon as the construction was newly built, the authorities came to inspect and handle it, but for some reason it was still completed and exists until now.

Overview of illegal construction works in Ea Drang town

According to the explanation of Mr. Pham Van Nhat, Vice Chairman of Ea Drang Town People's Committee, on January 17, 2022, Ea Drang Town authorities discovered that the landowner was building a surrounding fence, so they inspected, made a record, requested to temporarily stop construction and reported the incident to Ea H'leo District People's Committee.

Regarding the delay in handling the above-mentioned illegal construction, Mr. Nhat said: "The town discovered it early but thought that the landowner was only building a fence. Moreover, at that time, many officials were infected with Covid-19, so there were shortcomings in management, allowing the construction project to be completed."

Review the responsibility of many officials

Regarding the incident, Mr. Nguyen Van Ha, Chairman of the People's Committee of Ea H'Leo District, said that the total area where Mr. Thang built the works was nearly 2,000 m2 but only 50 m2 of residential land. Mr. Thang illegally built on the above land to open entertainment services and illegally profit. Therefore, the People's Committee of Ea H'Leo District recently decided to fine Mr. Thang nearly 30 million VND for illegal profiteering.

Mr. Ha said that the reason for the delay in handling Mr. Thang's project was due to subjectivity and incomplete assessment, so the Ea Drang Town officials and the Economic - Infrastructure Department were slow in determining Mr. Thang's violations. "The project was discovered in January 2022, but the local authorities were subjective and did not immediately suspend construction. The project was completed in April 2022. Recently, we have handled and reviewed the responsibilities of the Chairman and Vice Chairman of the Ea Drang Town People's Committee and the leaders of the Economic - Infrastructure Department," Mr. Ha informed.

Regarding the illegal constructions that Mr. Thang built, Mr. Ha said that comparing the land use planning until 2030 of Ea H'Leo district (approved by the People's Committee of Dak Lak province), the land area that Mr. Thang used was only 50 square meters of residential land, the rest was commercial service planning land, public entertainment and recreation planning land and a part of traffic planning land.

Therefore, the district requires Mr. Thang's household to demolish the constructions and structures built on agricultural land and traffic land with an area of ​​about 400 m2 . Particularly for the constructions on the remaining area of ​​about 1,509 m2 (land in the commercial service, entertainment planning), Mr. Thang's household must carry out procedures to request permission to change the land use purpose from the competent authority according to the provisions of law.

"Currently, Mr. Thang's family has demolished part of the fence. If by the end of May, Mr. Thang does not voluntarily remedy the consequences and dismantle the illegal constructions on agricultural land and land planned for traffic land, we will resolutely enforce and strictly handle it," said Mr. Ha.

Previously, Thanh Nien reported that in 2022, at Doan Thanh horse farm (in Cu Ebur commune, Buon Ma Thuot city, Dak Lak), there were many illegal constructions on agricultural land, aimed at exploiting tourism and entertainment. In early 2023, the People's Committee of Buon Ma Thuot city issued a decision to fine the owner of this farm, forcing the demolition of illegal constructions and restoring the land status, but to date, the restoration has not been completed.
