Continuing the 50th Session, on the afternoon of October 9, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on Technology Transfer.

Briefly presenting the draft Law, Minister of Science and Technology Nguyen Manh Hung said that the amendment and supplement to the Law on Technology Transfer aims to institutionalize the Party's policies and guidelines and implement the National Assembly's Resolutions in recent documents. These are Resolution No. 57-NQ/TW of the Politburo on breakthroughs in science and technology development, innovation and digital transformation; Resolution No. 68-NQ/TW of the Politburo on private economic development; Resolution No. 66-NQ/TW of the Politburo on innovation in law-making and enforcement to meet the requirements of national development in the new era.

The promulgation of the Law amending and supplementing a number of articles of the Law on Technology Transfer aims to continue to perfect the legal framework to promote technology transfer activities effectively, synchronously, in accordance with practical requirements and socio -economic development policies, while keeping up with world trends in technology transfer; Strengthening decentralization, simplifying administrative procedures on technology transfer, strengthening information and statistics on technology transfer to serve state management.

Along with that is promoting innovation and endogenous technology transfer, creating a flow of technology between domestic enterprises, organizations and individuals and between higher education institutions, research facilities and enterprises, organizations and individuals; Developing an effective, transparent and professional science and technology market, creating a favorable environment for technology transactions and intellectual property, contributing to improving productivity, quality and competitiveness of the economy.

Presenting a summary of the review report, Vice Chairman of the National Assembly's Committee on Science, Technology and Environment Nguyen Phuong Tuan basically agreed with the expansion of a number of technology transfer subjects in line with world trends such as green technology and clean technology.

However, Mr. Nguyen Phuong Tuan said that expanding the scope of "technology appraisal" without limiting it to "investment projects" as stipulated in the current Law needs to continue to be reviewed to ensure feasibility in implementation and synchronization with relevant laws.

Regarding the State's policy on technology transfer activities, the drafting agency reviews and studies to supplement a strong and substantial incentive mechanism to effectively implement the policy of "focusing on spreading technology... from foreign-invested enterprises (FDI) to domestic enterprises"; researches the content of supplementing the subject of small and medium-sized enterprises.

At the same time, the Vice Chairman of the National Assembly's Committee on Science, Technology and Environment said that it is necessary to study and consider a mechanism to control the regulation allowing self-determination of appropriate technology contribution value to ensure flexibility and the rights of third parties; supplement the regulation assigning the Government to specifically regulate "price appraisal"; specify the support measures "encouraging capital contribution by technology" and "support measures through price appraisal..." in other provisions of the draft Law or assign the Government to regulate in detail to ensure feasibility.

The National Assembly's Committee on Science, Technology and Environment requested the drafting agency to study and determine the roadmap for applying the regulation: Organizations and individuals participating in technology transfer activities are responsible for providing complete, accurate and timely information related to technology transfer activities on digital platforms..., ensuring compliance with practical conditions.

At the meeting, regarding the responsibility for state management and decentralization in "assessing the effectiveness of technology transfer using the state budget", some delegates suggested that the drafting agency supplement the regulation assigning the Government to specify this content in detail; There were opinions suggesting considering supplementing the regulation assigning the provincial People's Committee to be responsible for organizing the assessment of the effectiveness of technology transfer in the locality for programs, projects and tasks using the state budget; Periodically report the assessment results annually to the Ministry of Science and Technology for synthesis, monitoring and reporting to the Government.

Agreeing with the scope of amendments as proposed by the Government, Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung suggested clarifying some contents to ensure consistency and synchronization with other laws such as the Law on Science, Technology and Innovation; Law on Corporate Income Tax; Law on Intellectual Property and Law on High Technology...

Considering that the wording and scope of provisions between the draft Law and the Law on Corporate Income Tax are not consistent, which may cause difficulties in application, Mr. Hoang Thanh Tung suggested that the drafting agency review and adjust the wording to ensure consistency; in case of wanting to add new tax incentives, it is necessary to propose synchronous amendments to the Law on Corporate Income Tax to ensure feasibility and legal consistency.

Speaking at the Session, National Assembly Chairman Tran Thanh Man noted that the amendment to this Law aims to "promote endogeneity and commercialization", overcoming the situation of "research then put in the drawer", "suspended research". The amendment to the Law will support startups, contributing to improving labor productivity and the digital economy, which the Ministry of Science and Technology is currently strongly promoting in digital transformation, digitization, and digital economy.

In addition, the National Assembly Chairman requested to strongly integrate tax incentives, capital support through innovation funds and require transfer commitments from international investors, creating incentives for foreign enterprises to invest, promoting FDI capital flows to bring high technology; must be transparent, professionalize the market, especially regulations on central trading floors and technology announcement to help the science and technology market become more effective, reduce risks, and increase supply-demand connections.

The National Assembly Chairman requested the Drafting Agency to carefully study and coordinate with the Ministry of Finance and localities in technology valuation and short-term licensing procedures, to help motivate businesses to participate.

"For the Law Project to be feasible, it is necessary to focus on perfecting, synchronizing and simplifying procedures; increasing incentives and balancing both sides to share risks; building a measurement and monitoring mechanism; expanding support for disadvantaged areas and strategic technology...", the National Assembly Chairman suggested.
