Ho Chi Minh City builds a project to amend Resolution 98 to remove bottlenecks

Ho Chi Minh City will comprehensively review the specific mechanisms stipulated in Resolution No. 98/2023/QH15, thereby proposing adjustments and supplements to meet the practical requirements of the City after the merger.

The People's Committee of Ho Chi Minh City has just issued a Plan to develop a Project proposing to amend and supplement a number of articles of Resolution No. 98/2023/QH15 on special mechanisms for the development of Ho Chi Minh City.

The project aims to review and comprehensively evaluate the implementation of Resolution No. 98, clearly pointing out bottlenecks, difficulties and problems in the process of applying specific mechanisms and policies.

From there, the City proposes new mechanisms and policies that are innovative, reasonable, and suitable to reality, ensuring high efficiency, creating conditions for Ho Chi Minh City to continue promoting its role as an economic locomotive, increasing its attractiveness to strategic investors, and enhancing its competitiveness in the region and the world.

The Can Gio international transit port project is facing problems related to regulations on investment capital disbursement.

The City People's Committee assigned relevant departments, branches, sectors and units to review and classify mechanisms and policies into 3 groups: mechanisms and policies that need to be abolished; mechanisms and policies that are still suitable for the new context and situation; and mechanisms and policies that need to be proposed for adjustment and supplementation.

For mechanisms and policies that are still suitable for the new context and situation after the merger and implementation of the two-level local government organization, the City People's Committee requests agencies and units to propose and send them to the Department of Finance to preside over and coordinate with the Department of Justice to review and advise the City People's Committee on continued implementation.

For mechanisms and policies that need to be proposed for adjustment or supplementation, agencies and units must clarify bottlenecks, difficulties, and problems in the implementation process and the basis for the proposal.

The Ho Chi Minh City People's Committee requested departments and branches to develop and complete the Project in September 2025, considering this an important political task, creating a foundation for the new development stage of the City.

Heads of agencies and units must directly direct and urge progress, ensure quality of consultation and closely coordinate to soon complete the Project and draft Resolution amending and supplementing Resolution No. 98.

Currently, the implementation of Resolution No. 98 is facing a number of difficulties, including the disbursement of investment capital in the City's strategic projects.

A typical example is the Can Gio International Transit Port Project. According to the Resolution, strategic investors must disburse all capital within 5 years. Meanwhile, this project has a total investment capital of 113,531 billion VND (equivalent to 4.8 billion USD).

According to the investor's calculation, the Project is divided into investment phases with an implementation period of 22 years, so disbursing the entire 4.8 billion USD in 5 years is not feasible.

Therefore, the investor proposed to amend the regulation in the direction that enterprises must disburse investment capital (at least 50,000 billion VND or more) within 10 years from the date of land handover on site.
