Vice Chairman of the Ho Chi Minh City People's Committee Bui Minh Thanh has just signed to convey the direction of the Chairman of the Ho Chi Minh City People's Committee to assign Saigon Trading Group - One Member Limited Liability Company (SATRA) to work with the Department of Finance and the Department of Construction to review the conditions for continuing to use the land plots at 135 Nguyen Hue and 39 Le Loi, Saigon Ward (Tax Trade Center) to implement the project.
In case the prescribed conditions are not met, SATRA shall issue a document to return the land in accordance with the provisions of Clause 2, Article 82 of the 2024 Land Law.
In case SATRA returns the land, the Chairman of the People's Committee of Saigon Ward shall preside over and coordinate with relevant units to organize a field inspection of the land; prepare a dossier to recover the land according to authority and hand over the land to the City Land Fund Development Center for management.
Previously, SATRA sent a document to the People's Committee of Ho Chi Minh City proposing that the People's Committee of Ho Chi Minh City recommend the Government to allow enterprises to invest on public land areas and approve SATRA to lease land without auctioning land use rights according to the provisions of the 2024 Land Law.
Tax Trade Center was started in 1922, inaugurated on November 26, 1924, with the function of a commercial center. The original building had only 3 floors with 2 entrances on Nguyen Hue Street and the corner of Nguyen Hue - Le Loi.
In 2016, SATRA was assigned to carry out the project and demolish the Tax Trade Center to build a new building called Satra Tax Plaza, 40 stories high. The building was expected to start construction in the first quarter of 2017 and be completed in 2020, but to date it is still an empty lot.
According to the design, Satra Tax Plaza is a building with an entrance connecting to the station of metro line 1 (Ben Thanh - Suoi Tien); 2 basements for shopping mall, supermarket, services, entertainment; 4 basements for parking and a helipad.
Tax Trade Center project investment has many problems
In 2021, the Ho Chi Minh City People's Committee issued an official dispatch reporting and proposing the Prime Minister to approve the policy of letting SATRA lease land at the Tax Trade Center location without auction to implement the investment project to build a trade center, services, offices, and hotels.
However, at that time, all ministries and branches had opinions that SATRA's project implementation was not in accordance with regulations.
Firstly, the land is directly managed by the State, so it must be arranged and handled according to the provisions of Decree 167. There is no basis for allocating land to SATRA without auction. Secondly, SATRA's proposal to implement the project is an investment outside its main business line, which is not in accordance with the provisions of the decrees.
Therefore, the City People's Committee has assigned the Department of Finance to guide SATRA in implementing the plan to rearrange and handle real estate according to Decree 167 to submit to Steering Committee 167 for appraisal and approval.
On that basis, the selection of investors or management of the land will be carried out in accordance with the approved plan and current regulations. The City People's Committee also assigned the relevant departments to clarify the compliance with the regulations on restricting investment outside the main business sector when SATRA implements the project.
