Phu Tho: Resolutely reclaim land if enterprises do not complete construction investment after the extended deadline

Phu Tho province has just extended the land use schedule for the Hong Ha Gas Filling Station project of An Khanh Vinh Phuc General Company Limited for another 24 months. The Provincial People's Committee emphasized that after the extension period, if the investor fails to complete the project, the entire land area will be reclaimed without compensation according to current regulations.

According to the Decision, the land area with extended progress of use is 4,110.2m2 at Tan Tien Socio-Economic Cluster, Vinh Thanh Commune, Phu Tho Province (formerly Lung Hoa Commune, Vinh Tuong District, Vinh Phuc Province). The extension period is 24 months from the date of issuance of the Decision.

An Khanh Vinh Phuc General Company Limited is responsible for:

Fulfill financial obligations regarding land to the State during the period of land use progress extension ( land rent , non - agricultural land use tax , amount of money corresponding to the period of land use progress extension ) ; other obligations of land users as prescribed by law.

Contact the Department of Finance to carry out procedures to adjust the project investment progress according to the provisions of law; promptly implement the project according to the approved investment content and the extended period of land use progress.

After the above-mentioned extension period, a written report must be sent to the Provincial People's Committee (through the Department of Agriculture and Environment ) on the completion of construction investment according to the approved project. If the investor has not completed the construction investment after the extension period, the State will reclaim the land according to the provisions of Clause 8, Article 81 of the 2024 Land Law without compensation for land; assets attached to land and remaining land investment costs.

The Provincial People's Committee assigned the Provincial Tax Department to determine and notify the amount that An Khanh Vinh Phuc General Company Limited must pay during the period of land use progress extension as prescribed in Clause 8, Article 81 of the 2024 Land Law and its implementing documents.

The Department of Agriculture and Environment shall inspect and monitor the land use progress of An Khanh Vinh Phuc General Company Limited; proactively advise the Provincial People's Committee to handle the extended land area when the extension period expires and the Company has not yet invested in construction of works according to the project approved by the competent authority.

The Department of Finance inspects, supervises and guides An Khanh Vinh Phuc General Company Limited to fully comply with the provisions of law on investment during the project implementation process.
