Is drinking alcohol and riding a motorbike on a village road punishable?

According to Point c, Clause 2, Article 6 of Circular 32/2023/TT-BCA, village/commune roads belong to the routes and patrol and control areas of district-level police.

Therefore, district police will have the right to handle administrative violations of people participating in traffic on village roads.

Violating alcohol concentration is one of the violations of traffic participants, therefore, traffic participants using alcohol on village roads or national highways will be handled.

Regarding the penalty for alcohol concentration violations for motorcyclists, there are three different levels of punishment.

Fine from 2 to 3 million VND if alcohol concentration does not exceed 50 milligrams/100 milliliters of blood or does not exceed 0.25 milligrams/1 liter of breath. Additional penalty is driving license revocation from 10 to 12 months.

Fines of 4 - 5 million VND if alcohol concentration exceeds 50 milligrams to 80 milligrams/100 milliliters of blood or exceeds 0.25 milligrams to 0.4 milligrams/1 liter of breath. Additional penalty is revocation of driving license for 16 - 18 months.

Fines of 6-8 million VND if alcohol concentration exceeds 80 milligrams/100 milliliters of blood or exceeds 0.4 milligrams/1 liter of breath. Additional penalty is revocation of driving license for 22-24 months.

Therefore, people need to take note, absolutely do not use alcohol before and when driving to avoid endangering themselves and other road users, as well as avoid being fined, having their vehicle impounded, and having their driver's license revoked.

Penalty for alcohol concentration in cars

Alcohol concentration does not exceed 50 milligrams/100 milliliters of blood or does not exceed 0.25 milligrams/1 liter of breath. Violators are fined from 6 million to 8 million VND. (Point c, Clause 6, Article 5). Driver's license is revoked for 10 to 12 months (Point e, Clause 11, Article 5).

Exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath. Violators will be fined from 16 million to 18 million VND. (Point c, Clause 8, Article 5). Driver's license will be revoked for 16 to 18 months (Point g, Clause 11, Article 5).

Exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath. Violators will be fined from 30 million to 40 million VND. (Point a, Clause 10, Article 5). Driver's license will be revoked for 22 to 24 months (Point h, Clause 11, Article 5).

In addition, the person with the authority to handle alcohol concentration violations may decide to temporarily detain the vehicle for up to 7 days.
