
Presenting the draft Law, Minister of Science and Technology Nguyen Manh Hung stated that the amendment and supplement to the Law on Technology Transfer aims to institutionalize the Party's policies and implement the State and National Assembly's directions on science, technology and innovation development; private economic development; building a legal system; and promoting decentralization and delegation of power.

The draft Law focuses on amending and supplementing incentive policies and supporting enterprises in research activities, receiving, mastering and innovating technology, especially in priority areas, new technology, green technology and digital transformation; creating mechanisms for enterprises to improve their competitiveness, expand markets, and contribute to affirming the country's position in the region and internationally.

The Draft Law expands the scope of regulation in the direction of: not only covering traditional technology but also regulating new technology, green technology, digital technology; increasing incentives and encouragement: building financial, tax, credit, and investment policies to support businesses, research institutes, and innovation centers to participate in receiving and transferring new technology: considering the transfer and application of new technology as a pillar of developing modern productive forces, at the same time, associated with the goals of green transformation, digital transformation, development of digital economy and circular economy.
Reviewing this content, Deputy Chairman of the Committee for Science, Technology and Environment Nguyen Phuong Tuan said that the Standing Committee of the Committee agreed on the viewpoints, objectives and scope of amendments to the draft law. The content of the draft law is consistent with the Party's innovation policies and guidelines; promptly removes difficulties and shortcomings in state management, meets practical requirements and international integration. The draft law is submitted according to a shortened order and procedure, the draft law dossier is seriously prepared, basically ensuring compliance with the requirements specified in Clause 5, Article 51 of the Law on Promulgation of Legal Documents, and is eligible to be submitted to the National Assembly.

Regarding the scope of regulation, the Standing Committee of the Commission basically agrees with the expansion of a number of technology transfer subjects in line with world trends (such as green technology, clean technology).
However, with the expansion of the scope of "technology appraisal" which is not limited to "investment projects" as stipulated in the current Law on Technology Transfer, it is necessary to continue reviewing to ensure feasibility in implementation and synchronization with relevant laws.

Regarding the State's policy on technology transfer activities (Clause 3, Article 1), it is recommended that the drafting agency review and research to supplement a strong and substantial incentive mechanism to effectively implement the policy of "focusing on spreading technology... from foreign-invested enterprises (FDI) to domestic enterprises"; at the same time, research the content of supplementing the subject of small and medium-sized enterprises.
Commenting on this content, National Assembly Chairman Tran Thanh Man emphasized that this amendment to the Law needs to achieve the goal of enhancing endogenous capacity and promoting commercialization of research results in higher education institutions, institutionalizing Resolution 57-NQ/TW on breakthroughs in science and technology development, innovation and national digital transformation.

The National Assembly Chairman suggested that the draft Law should integrate strong incentive policies to attract strategic investors and leading foreign-invested technology enterprises (FDI) to Vietnam, along with requirements for technology transfer from FDI enterprises to domestic enterprises.
Along with that, there needs to be a mechanism to measure the rate of commercialization of research results, technology transfer and an effective monitoring mechanism.
Agreeing with the above opinion, Chairman of the Committee for Culture and Society Nguyen Dac Vinh also suggested that there should be solutions to encourage and promote the import and transfer of new and advanced technological solutions; and solutions to ensure effective implementation.
Chairman of the Committee on Law and Justice Hoang Thanh Tung suggested that the drafting agency review and ensure the consistency of the draft Law with related laws, especially the Law on Science, Technology and Innovation.
