Requesting leaders of ministries, provincial and municipal chairmen to participate in explaining

National Assembly Chairman Vuong Dinh Hue signed a Resolution guiding the organization of explanation activities at meetings of the National Assembly's Ethnic Council and committees.

This Resolution guides Article 37 and Article 43 of the Law on Supervisory Activities of the National Assembly and People's Councils and relevant legal provisions on organizing accountability activities at meetings of the National Assembly's Ethnic Council and Committees.

Including: Principles and scope of explanation; criteria for selecting issues to be explained, persons requested to explain, persons requested to participate in explanation; sources of information for selecting issues to be explained; responsibilities and rights of persons requested to explain, relevant agencies, organizations and individuals; order and procedures for organizing explanation activities; implementing conclusions on issues to be explained; monitoring, urging and reporting on the implementation of conclusions on issues to be explained by the Council of Nationalities and Committees of the National Assembly.

According to the Resolution, the explanation sessions are held publicly, except in cases where the issues to be explained involve State secrets, work secrets, personal secrets, family secrets, private life, business secrets protected by law, or other cases decided by the Standing Committee of the Nationalities Council or the Standing Committee of the National Assembly.

Policy - Requiring leaders of Ministries, Provincial and Municipal Chairmen to participate in explaining — The National Assembly's Committee on Judiciary held a session to explain the implementation of the law on preventing and combating human trafficking on May 8, 2023.

The scope of explanation is the issue within the area of responsibility of the National Assembly's Council of Nationalities and Committees; the issue within the area of responsibility of the National Assembly's Council of Nationalities and Committees and related to the area of responsibility of other Committees of the National Assembly and the National Assembly's Council of Nationalities.

The issue to be explained is selected according to one of the following criteria: Specific issue, incident that is topical, urgent, and arises in social life; issue that is of interest to many National Assembly deputies , members of the Ethnic Council, members of the National Assembly Committee, public opinion, voters and people, requiring timely clarification and resolution to ensure the interests of the State, the rights and legitimate interests of organizations and individuals;

The problem of violations of the law or many limitations and weaknesses that are slow to be overcome;

The issues have been recorded in the Resolutions of the National Assembly, the National Assembly Standing Committee on questioning, thematic supervision or conclusions on issues explained, recommendations for thematic supervision by the Ethnic Council, the National Assembly Committees but have not been implemented effectively, not meeting the requirements set forth.

The person required to explain is a member of the Government, Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy , and State Auditor General.

The selection of the person required to explain for a specific explanation session must be the head of the agency with direct State management authority or with the function, task, and responsibility to resolve the issue being explained.

At the same time, the person required to participate in the explanation is the representative of the leader of the Ministry, branch, Chairman of the People's Committee of the province or centrally-run city or other individual related to the State management authority or having the function, task and responsibility to resolve the issue being explained .
