Perspective of Gia Binh airport
The Government has just issued Resolution No. 3/2025/NQ-CP dated August 14 on special mechanisms and policies for investment in the construction of Gia Binh International Airport.
The Resolution stipulates specific mechanisms and policies for projects at Gia Binh International Airport, including: Airport construction, works to ensure flight operations, resettlement, works serving site clearance and direct connecting roads. These projects are implemented under the public-private partnership (PPP) method.
The Resolution applies to ministries, ministerial-level agencies, People's Committees at all levels and relevant organizations and individuals. The specific mechanism focuses on three groups: investment - construction - investor selection; planning; environment and land.
Regarding investment, construction, and investor selection, projects are implemented simultaneously with the planning adjustment and construction commencement procedures, along with the investment policy approval procedures. Investors do not have to apply for a construction permit, but must complete the construction commencement conditions within 6 months from the commencement date.
The Ministry of Public Security decided to select an investor for the airport project under a special form before the National Assembly approved the investment policy; transferring the land and invested assets in their original state to the People's Committee of Bac Ninh province, to hand over to the investor to implement the project.
The investor must reimburse the costs incurred by the Ministry of Public Security and the Provincial People's Committee for land acquisition, compensation, resettlement support, technical and social infrastructure.
The project to ensure flight operations at Gia Binh International Airport is implemented under a build-transfer (BT) contract, paid for with state budget capital, without having to decide on investment policy according to the PPP law. The Ministry of Public Security is the governing body, signing the contract and arranging payment capital.
The Ministry of Construction is responsible for coordinating with the Ministry of Public Security to ensure the technical standards and regulations of the Investment Project to construct works to ensure flight operations of Gia Binh International Airport and is the beneficiary of the assets resulting from the project implementation process according to the provisions of law.
The People's Committee of Bac Ninh province is the competent authority responsible for preparing, approving, signing project contracts, balancing and arranging land funds to pay investors according to the BT Contract.
Regarding the specific mechanisms and policies on planning, environment, land, the approved master plan for the development of the national airport system for the period 2021-2030, with a vision to 2050, and the Bac Ninh Provincial Planning for the period 2021-2030, with a vision to 2050, are adjusted according to a simplified procedure, without a strategic environmental assessment; related specialized planning is adjusted at the same time. The competent authority can decide on content different from the existing planning and plan, then review and update.
The People's Committee of Bac Ninh province shall base on the Gia Binh International Airport Planning and detailed planning of projects to approve compensation, support and resettlement plans; carry out land recovery, allocation and lease; and use rice-growing land according to project needs to change the purpose of use.
The resolution takes effect from August 14 until the projects are completed.
