The Ministry of Industry and Trade issued new regulations on the functions, tasks and powers of the Electricity Regulatory Authority.

Pursuant to Decree No. 105/2024/ND-CP dated August 1, 2024 amending and supplementing a number of articles of Decree No. 96/2022/ND-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade , Decree No. 26/2018/ND-CP dated February 28, 2018 of the Government on the Charter of organization and operation of Vietnam Electricity Group (EVN) and Decision No. 753/QD-TTg dated August 1, 2024 of the Prime Minister approving the policy of transferring the right to represent state capital ownership at the National Electricity System and Electricity Market Operation One Member Limited Liability Company from the State Capital Management Committee at Enterprises to the Ministry of Industry and Trade... on August 15, 2024, the Minister of Industry and Trade signed and issued Decision No. Decision No. 2179/QD-BCT stipulates the functions, tasks, powers and organizational structure of the Electricity Regulatory Authority - Ministry of Industry and Trade, replacing Decision No. 2630/QD-BCT dated December 2, 2022 of the Minister of Industry and Trade stipulating the functions, tasks, powers and organizational structure of the Electricity Regulatory Authority.

Accordingly, the Electricity Regulatory Authority performs the function of advising the Minister of Industry and Trade on state management and law enforcement regarding the task of regulating electricity activities to provide safe, stable, quality electricity, use electricity economically, effectively and ensure fairness and transparency; organize and manage public service activities in the field and scope of management of the Authority according to the provisions of law and decentralization and authorization of the Minister.

Decision No. 2179/QD-BCT has a number of main points supplemented and amended as follows:

- Adjust the phrase "fee" to "price" according to the provisions of the new Price Law taking effect.

- Additional: Electricity distribution price

- Supplement: Regulations on operation, command and control of the production, transmission, distribution and allocation of electricity in the national power system.

- Supplement: Appraisal, issuance, amendment, supplementation and revocation of electricity operation licenses for electricity transmission activities and electricity generation activities for large power plants of special importance in terms of socio -economics, national defense and security in the list approved by the Prime Minister under the authorization of the Minister and provisions of law.

- Supplement: Perform state management tasks according to authority over the command and operation of the production, transmission, distribution and allocation systems of electricity in the national power system, and operate electricity market transactions.

- Additional: Take charge in the assigned field of managing the implementation of rights, responsibilities and obligations of the state owner towards the National Electricity System and Market Operation Company (NSMO). Monitor the production, business and investment activities of NSMO. Synthesize reports on all aspects of NSMO's activities.
