Proposal to abolish both exams and promotion of civil servants

In the draft Law on Civil Servants (amended) submitted to the National Assembly, the Ministry of Home Affairs proposed to remove the regulation on exams or consideration for promotion of professional titles of civil servants.

In the draft law, the Ministry of Home Affairs proposed to innovate the recruitment, use and management of civil servants according to job positions. Accordingly, all recruitment, arrangement and use of civil servants must be based on the requirements of the job position and work efficiency.

Notably, the draft law proposes not to conduct exams or consider promotions for professional titles of civil servants.

Officials such as doctors, teachers... will no longer have to take exams or be considered for promotion to professional titles.

According to the current Civil Servant Law, civil servants are required to take exams or be considered for promotion in their professional titles. By December 2023, the Government issued Decree 85, removing regulations on civil servant promotion exams. Civil servants can only register for promotion if they meet the standards of capacity, expertise, and professionalism.

In this draft revised Law on Civil Servants, the Ministry of Home Affairs proposed to remove the consideration of promotion of professional titles to manage civil servants according to job positions.

The Law on Cadres and Civil Servants, passed by the National Assembly at its 9th session last June, also removed the regulation on exams and rank promotion for civil servants, although it still maintains the civil servant rank to distinguish ranks in the job position system.

Along with eliminating exams and promotion, the draft law also innovates the method of recruiting civil servants. Accordingly, public service units are allowed to proactively choose appropriate recruitment methods, including competitive exams, public recruitment and admission of high-quality human resources.

Notably, the Ministry of Home Affairs proposed allowing the admission of experts, scientists, talented or experienced people from the non-public sector to civil service positions.

At the same time, it is allowed to sign labor contracts or service contracts with experts and scientists (both Vietnamese and foreigners) to perform management, operation or professional and technical tasks...

Can dismiss an employee who fails to complete his/her duties

In the draft Law on Civil Servants (amended), the Ministry of Home Affairs also proposed to innovate the evaluation mechanism for civil servants. Accordingly, the evaluation will be carried out regularly, continuously and based on quantitative criteria linked to work results.

The draft law also removes the provision requiring dismissal of civil servants who fail to complete their tasks for two consecutive years. Instead, the draft law stipulates that, based on the results of periodic or annual quality assessment and classification, competent authorities can arrange jobs at a lower level or dismiss civil servants who fail to complete their tasks or do not meet job requirements.

At the same time, the draft law also proposes to expand the rights of civil servants, including regulations allowing civil servants to sign labor contracts or service contracts with other units (non-public) if they are not contrary to the signed work contract and are agreed by the head of the unit.

The draft law proposes that civil servants are allowed to contribute capital, participate in the management and operation of enterprises, except in cases where specialized laws provide otherwise. In particular, civil servants at scientific and technological organizations and public higher education institutions are allowed to participate in the management and operation of enterprises established by those units to commercialize research results...

In addition, the draft law also proposes to add provisions on civil servants being considered for exclusion, exemption or reduction of legal liability if there are errors in implementing innovative and creative proposals for the common good and have been approved by competent authorities.
