Speaking at a press conference on the preparation and organization of the 1st Government Party Congress for the 2025-2030 term on the morning of October 9, Minister of Justice Nguyen Hai Ninh said that the Resolution of the 13th Party Congress identified institutions as one of three strategic breakthroughs.
Resolution 66-NQ/TW of the Politburo recently also clearly stated that the legal institution must become a breakthrough of breakthroughs and required the work of building legal institutions not only to remove bottlenecks in practice but also to create competitive advantages, creating a solid legal foundation to mobilize all resources for socio-economic development, meeting the requirements of national development in the new era.
During the last term, the Government and the Prime Minister have always paid attention to, led, and directed this work closely and resolutely. Ministries, ministerial-level agencies and especially the heads and ministers have really taken part and created very outstanding results in the work of building institutions and laws.
Specifically, during this term, the Government Party Committee has advised the Politburo to issue many documents on law-making. The Government has advised and actively coordinated with relevant agencies to submit to the Central Executive Committee and the Politburo major policies, guidelines and viewpoints for the work of perfecting institutions and building laws, such as issuing Resolution No. 27-NQ/TW on continuing to build and perfect the socialist rule-of-law state of Vietnam in the new period. This is a very important fundamental Resolution in building the rule-of-law state of Vietnam.
Next, the Politburo issued Decision No. 178 on controlling power, preventing corruption and negativity in law-making work - there is a separate regulation of the Politburo on controlling power in law-making work.
Recently, the Politburo issued Resolution No. 66 dated April 30, 2025 on innovating the work of building and organizing law enforcement to meet the requirements of national development in the new era, with many very important orientations, innovative in both thinking and action in the work of building and organizing law enforcement.
The Government Party Committee also submitted to the Politburo a decision to establish a Central Steering Committee on institutional and legal improvement, with the General Secretary as its Head, and the Party Committee of the Ministry of Justice as its Standing Body. "These are extremely important changes, demonstrating the special attention of the Politburo, the Secretariat, the Government and the Prime Minister to the work of institutional development in the new period," the Minister of Justice emphasized.
The Government and the Prime Minister have closely and resolutely directed the work of perfecting the legal system, achieving many important results reflected in the quantity and quality of issued documents. Particularly during the term, statistics up to this point, in addition to regular meetings of the Government, the Government has organized 41 thematic meetings on law-making work.
Since the beginning of the term, the Government has submitted to the National Assembly 121 laws and resolutions. In 2021, the Government submitted to the National Assembly 5 laws and resolutions; in 2022, the Government submitted to the National Assembly 17 laws and resolutions; in 2023, the Government submitted to the National Assembly 20 laws and resolutions; in 2024, the Government submitted to the National Assembly 34 laws and resolutions. Particularly, from the beginning of 2025 to now, the Government has submitted to the National Assembly 31 laws and 16 resolutions (at the 9th Extraordinary Session and the 9th Session).
At the 10th Session, the Government plans to submit to the National Assembly for consideration and approval about 55 draft laws and resolutions. If this plan is followed, in 2025 alone, the Government will submit to the National Assembly for promulgation about 102 laws and resolutions - a record workload with the largest number of documents ever in a year.
Since the beginning of the term, the Government and the Prime Minister have issued 988 documents under their authority, including 813 decrees, 11 resolutions and 164 decisions. This is also a record amount of work in this term.
Regarding the quality of documents, according to the Minister, the achievements in socio-economic development of our country in recent times could not have been achieved without the work of building institutions and laws. In any field, if you want to do any work or innovate anything, you must first innovate through institutions and laws.
"Although we admit that there are still many bottlenecks, difficulties and problems with both subjective and objective causes, in general, the work of building and perfecting institutions and laws has made an important contribution to the socio-economic development of the country and positively contributed to the outstanding achievements of the Government in this term. More broadly, in the past 40 years of innovation, with such very important achievements, without a synchronous, feasible and high-quality legal system, we could not have achieved these achievements," affirmed Minister of Justice Nguyen Hai Ninh.
At the same time, the Government Party Committee has also directed strong innovation in the work of building and organizing the implementation of laws. Notably, it has directed the Government to submit to the National Assembly the Law on Promulgation of Legal Documents with many innovations. For the first time, we have recorded the mechanism for guiding the application of laws. This is a very new mechanism that is highly supported and welcomed by businesses, local authorities and people. With documents that have problems in application, we can completely make recommendations to competent authorities for guidance on the application of laws, instead of just having a mechanism to explain the laws as before. This has solved many problems in practice.
Along with that, more attention has been paid to publicity and transparency in the development and implementation of laws. For example, the Government has launched and operated the National Legal Portal, a very good two-way interaction channel between competent authorities and people, businesses, and local authorities. At the same time, the Policy Feedback Information Receiving System has been launched and operated. The Ministry of Justice has received a lot of information and has a public regulation. Instead of sending paper documents to each Ministry, we can now send public feedback on a digital platform and receive public responses along with evaluation of the results. This has been highly appreciated by law firms, lawyers, businesses, and local authorities. The Prime Minister is the Head of the Steering Committee for reviewing and removing obstacles in the Government's law-making work. This is a very special mechanism and has recently removed many obstacles.
Another point shared by Minister of Justice Nguyen Hai Ninh is that this term has linked the work of organizing law enforcement with the work of law making. Typically, we have organized a comprehensive review of obstacles, difficulties, and bottlenecks due to law implementation. Through 2,088 recommendations and reflections on difficulties and obstacles, the agencies have screened, of which about 1,300 are not difficulties or obstacles due to legal regulations and have been publicly responded to on the National Law Portal; 787 contents have been identified as needing to be handled.
"We are currently working with ministries and branches to handle urgent matters in 2025 under the direction of the General Secretary; non-urgent matters will be handled using special mechanisms and we will comprehensively amend the law before March 1, 2027 under the direction of the National Assembly," said Minister Nguyen Hai Ninh.
