Law on Teachers: Ensuring fairness and encouraging teachers in disadvantaged areas

At the 9th session of the 15th National Assembly, voters of Binh Thuan province (old) - now Lam Dong province, made a petition to the Ministry of Education and Training (MOET) regarding preferential allowances for teachers. Voters reported that on June 4, 2021, the Prime Minister issued Decision No. 861/QD-TTg approving the list of communes in regions III, II and I in ethnic minority and mountainous areas for the period 2021 - 2025. Accordingly, Binh Thuan (old) has 31 communes, of which Tanh Linh district has 7 communes (La Ngau commune in region III; Mang To, Duc Binh, Duc Thuan, Gia Huynh, Suot Kiet communes and Lac Tanh town in region I).

Voters request the Ministry of Education and Training to pay attention and give opinions on whether teachers and educational administrators working at public schools in communes in Region I of ethnic minority and mountainous areas in the period of 2021 - 2025 according to Decision No. 861 are entitled to the preferential treatment of 35% for secondary schools and 50% for kindergartens and primary schools as prescribed in Clause 1, Section 2 of Joint Circular No. 01/2006/TTLT - BGDĐT - BNV - BTC or not?

Responding to voters, the Ministry of Education and Training said that the preferential allowance regime for teachers is implemented according to the provisions of Decision No. 244/2005/QD-TTg dated October 6, 2005 of the Prime Minister and the guiding document. Accordingly, the 50% allowance applies to teachers who are directly teaching in kindergartens and primary schools; the 35% rate applies to secondary and high schools in mountainous areas, islands, remote areas. In Decision No. 861, it is stipulated that "communes in region III and region II approved in this decision, if recognized as meeting new rural standards, will be identified as communes in region I and will no longer enjoy the policies applied to communes in region III and region II from the date the decision of the competent authority recognizing the commune as meeting new rural standards takes effect".

This raises practical concerns because many teachers in newly recognized communes that meet new rural standards still have difficult socio-economic conditions, are far from the center, and have inadequate school facilities. If they do not continue to enjoy the policy, teachers will suffer. Faced with this reality, the Ministry of Education and Training said that it is coordinating with relevant ministries and branches to develop a new decree on preferential allowances for civil servants and employees in public educational institutions. The draft decree has taken into account more specific and flexible regulations, ensuring that teachers in communes in Region I, ethnic minority and mountainous areas, still receive allowances appropriate to the specific nature of their work.

In particular, on June 16, 2025, the National Assembly passed the Law on Teachers. This is an important milestone, creating a comprehensive and unified legal corridor in the development and implementation of policies for teachers. The law clearly stipulates the principles of treatment, allowances as well as specific policies for teachers working in disadvantaged areas, ethnic minority and mountainous areas. Documents guiding the implementation of the law will continue to be reviewed, adjusted, ensuring fair and reasonable policies, contributing to motivating and encouraging teachers to confidently commit to the profession for a long time.
