In Clause 7, Article 3 of the 2008 Road Traffic Law, a lane is a part of the roadway divided longitudinally, the lane has enough width for vehicles to run safely.

In particular, Article 9 of the 2008 Road Traffic Law emphasizes that traffic participants must drive in the correct lane and road section, comply with the road signal system and drive on the right side in the direction of travel.

Pursuant to Article 13 of the 2008 Road Traffic Law, regulations on lane use for road traffic participants include the following:

- On roads with multiple lanes for vehicles traveling in the same direction, separated by lane markings, drivers must stay in one lane and may only change lanes where permitted; when changing lanes, they must signal in advance and ensure safety.

- On one-way roads with lane markings, non-motorized vehicles must travel in the innermost right lane, motor vehicles and specialized motorbikes travel in the left lane.

- Road vehicles moving at lower speeds must keep to the right.

What is the fine for car lane encroachment in 2024?

According to Point d, Clause 5, Article 5 of Decree 100/2019/ND-CP, replaced and supplemented by Point d, Clause 34, Article 2 of Decree 123/2021/ND-CP, regulations on penalties for drivers of cars and similar vehicles violating road traffic rules are as follows:

“5. A fine of between VND 4,000,000 and VND 6,000,000 shall be imposed on a vehicle driver who commits one of the following violations:

d) Driving a vehicle not on the right side of the road in the direction of travel; driving in the wrong part of the road or lane (lane in the same direction or lane in the opposite direction) except for the acts specified in Point c, Clause 4 of this Article. Driving a vehicle across the fixed median strip between two lanes of traffic. Driving a vehicle on the sidewalk, except for the case of driving a vehicle across the sidewalk to enter a house.

7. A fine of between VND 10,000,000 and VND 12,000,000 shall be imposed on a driver who commits one of the following violations:

a) Not paying attention, driving at a speed exceeding the prescribed speed limit causing traffic accidents. Stopping, parking, turning, reversing, avoiding, overtaking, changing direction, or changing lanes in violation of regulations causing traffic accidents.

Not driving in the correct lane or lane, not keeping a safe distance between two vehicles as prescribed, causing a traffic accident, or entering a road with a sign prohibiting entry for the type of vehicle being driven, going in the opposite direction of a one-way road, going in the opposite direction on a road with a "No entry" sign, causing a traffic accident, except for the violations specified in Point a, Clause 8 of this Article.

11. In addition to the fine, the driver who commits the violation shall also be subject to the following additional penalties:

b) Committing the acts specified in Point d, Clause 2; Point h, Point i, Clause 3; Clause 4; Point a, Point b, Point d, Point dd, Point g, Point i, Clause 5 of this Article shall result in the suspension of the driving license from 1 to 3 months.

Driving a car in the wrong lane is a violation of the Road Traffic Law.

c) Committing the acts specified in Point c, Clause 5; Point a, Point b, Clause 6; Clause 7 of this Article shall result in the suspension of the right to use the Driver's License from 2 to 4 months. Committing the acts specified in one of the following Points and Clauses of this Article and causing a traffic accident shall result in the suspension of the right to use the Driver's License from 2 to 4 months.

Accordingly, for the violation of driving in the wrong lane by cars, there will be administrative penalties depending on the consequences as follows:

-Fine from 4,000,000 VND to 6,000,000 VND and driver's license revocation from 1 month to 3 months for driving in the wrong lane.

-Fine from 10,000,000 VND to 12,000,000 VND and have driver's license revoked from 2 to 4 months for driving in the wrong lane and causing a traffic accident.
