Pedestrians violating traffic laws, how are they punished?

According to regulations, pedestrians are one of the road traffic participants and are given priority in a separate lane called the sidewalk. Accordingly, pedestrians must comply with Article 32 of the Road Traffic Law 2008. Specifically, pedestrians must walk on the sidewalk or roadside. In cases where there is no sidewalk or roadside, pedestrians must walk close to the edge of the road.

Pedestrians are only allowed to cross the street in places with traffic lights, crosswalks, overpasses, or pedestrian tunnels, and must obey traffic signals.

In cases where there are no traffic lights, pedestrian crossings, overpasses, or tunnels, pedestrians must observe oncoming vehicles, only cross the street when it is safe, and are responsible for ensuring safety when crossing the street.

Pedestrians must not cross the median strip or hang onto moving vehicles; when carrying bulky objects, they must ensure safety and not cause obstacles for people and vehicles participating in road traffic.

“ Children under 7 years old must be led by an adult when crossing urban roads or roads with frequent motor vehicles; everyone has the responsibility to help children under 7 years old when crossing the road,” Clause 5, Article 32 provides in detail.

Also according to the 2008 Road Traffic Law, Clause 4, Article 11 stipulates that pedestrians will have priority at places with pedestrian crossings.

Accordingly, vehicle drivers must observe, reduce speed and give way to pedestrians and wheelchairs of the disabled crossing the road.

In addition, in places where there are no pedestrian crossings, drivers must observe and, if they see pedestrians or wheelchairs of disabled people crossing the road, must reduce speed and give way to pedestrians and wheelchairs of disabled people to cross the road safely.

Therefore, when pedestrians do wrong, they will be punished according to the provisions of Decree 100/2019. However, in reality, traffic police rarely punish these acts. Therefore, when the three people mentioned above are punished, it may surprise people.

Accordingly, the fine for pedestrians violating traffic laws is from 60,000 VND to 100,000 VND if they commit the following violations:

- Not driving on the correct side of the road; crossing the median strip; crossing the road in the wrong place or not ensuring safety.

- Failure to comply with the commands or instructions of traffic lights, signs, or road markings.

- Failure to comply with the orders or instructions of traffic controllers or traffic inspectors.

- Carrying bulky objects that obstruct traffic.

- Swing, hold on to moving vehicles.

Fines of VND 100,000 - 200,000 for pedestrians entering the highway, except for those serving in highway management and maintenance.
