Efforts to issue certificates to home buyers

Following the working process of Working Group 5013 (Group to remove obstacles to grant Certificates at housing projects), we have noted that many projects have investors who have made violations during the construction process or have problems with financial obligations, social housing obligations, etc. However, with the spirit of creating conditions for "honest" home buyers to be granted certificates, those violations or problems force investors to commit to correcting and implementing them later, and first proceed to grant certificates to home buyers.

When the fault is not the home buyer's

168 apartments at Dvela project (District 7) were dismantled by Team 5013 to issue certificates.

Mr. Tran Van Vinh, a resident of Tin Phong apartment building, Tan Thoi Nhat ward, district 12 (commercial name is 12 view apartment building) said that he bought an apartment here, paid in full and moved in nearly 10 years ago, but the certificate of land use rights and property ownership for the apartment is still nowhere to be found, despite having repeatedly requested the investor to expedite related procedures. This is also the common situation of the owners of nearly 400 apartments in this apartment building. The reason is that the project had construction violations and there was a dispute between the investor and a unit that bought back part of the project.

According to the documents we have, the Tin Phong Apartment project is invested by Tin Phong Construction Trading Production Company Limited. The project has an area of ​​19,472m2 , including nearly 10,000m2 of residential land, scale of 2 apartment blocks A, B; number of 408 apartments, height of 18 floors. During the construction and putting into use of the project, there were many violations and disputes between the investor and residents as well as between the investor and the transferor, causing the process of granting certificates to be prolonged.

Specifically, the investor arbitrarily changed the function and purpose of using the non-residential facilities in the mixed-use apartment building... The dispute between Hung Thinh Real Estate Investment and Trading JSC (the unit that bought back 387 apartments and transferred 387 apartments to customers) caused the two parties to "take each other to court" for a long time... All of the above problems caused the work of granting certificates to home buyers to stagnate.

At a recent meeting with Team 5013, Mr. Le Hong Duong, Legal Director of Hung Thinh Corporation, said that the correction of violations has been basically completed. Regarding the lawsuit filed by Tin Phong Company against Hung Thinh Company, Mr. Duong said that at this point, the court has suspended the case because the two parties have reached an agreement; with a fine of 275 million VND, Hung Thinh will arrange to pay the fine... In that spirit, Hung Thinh Company hopes that members of Team 5013 will consider granting certificates to customers who buy houses under contracts signed by Hung Thinh Company.

After listening to the opinions of the members of Group 5013, Director of the City Department of Agriculture and Environment Nguyen Toan Thang, who is also the Head of Working Group 5013, concluded that, for now, he agreed to grant certificates to people who bought houses. As for the violations that the investor has not yet corrected, there must be a written commitment to correct them and a time limit for correction.

Or the K26 Apartment Building was decided by the Ho Chi Minh City People's Committee in 2004 to allocate land to Project Board 98 (Ministry of National Defense) to invest in the construction of the K26 Apartment Building to serve the relocation and resettlement of military households within the scope of Tan Son Nhat Airport and households living in military barracks in Ho Chi Minh City. Since 2009, the investor has handed over 640 apartments to residents but to date there has been no certificate. Mr. Nguyen Toan Thang said that this is a special project, therefore, the Working Group will consider and resolve it according to regulations. If it exceeds the authority, it will report to the Interdisciplinary Team of the Ho Chi Minh City People's Committee and the Ministry of National Defense to consider and resolve... to soon issue certificates to home buyers.

Mr. Than The Hung, Deputy Director of the HCM City Land Registration Office, said that most members of Working Group 5013, in the process of reviewing projects, were in the spirit of "resolving obstacles" in the most beneficial way so that people could soon be granted certificates. "However, we must require investors to commit to fulfilling their obligations, such as investing and handing over full technical infrastructure and social infrastructure in the project according to the planning; fulfilling additional financial obligations when the competent authority has a decision... This way of working not only quickly resolves the legitimate rights of the people but also binds investors in the future," Mr. Than The Hung shared.

Contribute to socio -economic development

In fact, many projects have had their certificates "suspended" due to many objective reasons, affecting the rights of home buyers, and at times it seemed like there would never be an "end". Recently, nearly 800 apartments at the Garden Gate Apartment Project (No. 8 Hoang Minh Giam, Phu Nhuan District) and The Tresor Project (in Ben Van Don, District 4) were removed by Team 5013 to issue certificates according to regulations. At the Garden Gate project, the investor, Nova Festival Joint Stock Company, has completed most of its legal obligations, including paying land use fees and registration fees since 2017. The reason is due to the review of the project's financial obligations.

For The Tresor project, including 476 apartments, 239 officetels and 7 commercial units, the removal of obstacles is carried out in accordance with Resolution 170/2024/QH15 of the National Assembly and Decree 76/2025/ND-CP of the Government on special mechanisms for handling projects facing inspection, examination and judgment. The project has completed construction and acceptance in accordance with regulations. Mr. Phan Ngoc Bao An, General Director of Nova Phuc Nguyen, said that the delay in granting certificates to home buyers was due to many objective reasons. Therefore, when the obstacles were removed, both the investor and home buyers were very happy.

Director of the Department of Agriculture and Environment of Ho Chi Minh City Nguyen Toan Thang said that after its establishment and operation, with the results achieved, Working Group 5013 has been recognized by real estate businesses, organizations and people. At the same time, it has been evaluated by news agencies and newspapers as "a strategic step of the City to handle outstanding issues to promote the recovery and development of the real estate market".

Mr. Nguyen Toan Thang added that, in addition to the joy of businesses when the project is granted a certificate, another great "gain" that the Working Group has brought is the increased trust of businesses and people in land management; in addition, when real estate ownership is "legitimized", people and businesses will put it into exploitation, mortgage it for loans... thereby contributing significantly to the socio-economic development of Ho Chi Minh City in particular and the country in general. However, to continue to be worthy of the trust and recognition of society, the work of removing difficulties to grant certificates to home buyers at projects needs to receive more attention from agencies and units, especially from members of the Working Group.
