Facilitate resource use but manage it
Commenting on the draft Law amending and supplementing a number of articles of the Law on Geology and Minerals, members of the National Assembly Standing Committee basically agreed on amending and supplementing regulations on criteria for delimiting areas where mineral exploitation rights are not auctioned to ensure energy security, national defense and security, and effective use of important strategic minerals; ensuring raw materials and supplies for types of works, projects, and tasks specified in the draft Law.
Regarding the management of mineral resources, especially construction sand materials, Vice Chairman of the National Assembly Nguyen Duc Hai pointed out the fact that the current price of materials in some localities is very high, including for projects using public investment capital, projects of enterprises, and projects of people. This has led to an increase in the price of other products, greatly affecting the production and business situation of enterprises as well as the growth rate of localities.

Faced with that situation, the Vice Chairman of the National Assembly suggested that there should be sanctions as well as regulations on auction management and auction rules and regulations, allowing auction organizers to decide to suspend or review issues related to the auction when there are signs of irregularities.
“The draft Law must thoroughly reflect the spirit: we create conditions for the use of natural resources to serve the country's development but must manage them, avoid taking advantage of loopholes, losses, and avoid negative situations as well as influence on mineral exploitation activities,” the Vice Chairman of the National Assembly emphasized.
Extreme care in rare earth management
Agreeing with the fact that the draft Law has added a separate chapter to regulate the management, exploitation and use of rare earths, however, Chairman of the Law and Justice Committee Hoang Thanh Tung suggested that the drafting agency continue to research and consider adding a separate chapter on rare earths or adding a more general chapter regulating the management and use of strategic minerals , which includes many sections, including a section regulating general issues for strategic minerals, a section regulating rare earth minerals, and a section regulating other strategic minerals.

Designing a separate chapter on strategic minerals, according to the Chairman of the Law and Justice Committee, will ensure a more comprehensive and complete institutionalization of the Party's policies and guidelines. On that basis, to suit the practical situation, the Government will have detailed and specific regulations for each type of mineral.
Expressing his agreement, Chairman of the Delegation Work Committee Nguyen Thanh Hai said that, in addition to the resources that are very necessary in life such as construction materials, sand, stone, gravel, strategic minerals such as rare earth must be given special attention in management. Because rare earth is an important strategic material for the semiconductor industry, used to manufacture high-performance electronic components - this is one of our country's advantages in competition in science and technology development. Therefore, the drafting agency needs to pay attention to the regulations on assessing mineral exploitation reserves.

Regarding administrative procedures and regulations on licensing mineral exploitation, especially minerals used as construction materials, the Chairman of the Delegation Work Committee said that they are currently not really clear, which can easily lead to violations or cause delays and increase costs for businesses. Therefore, it is necessary to carefully review the draft Law to ensure consistency with other relevant laws such as the Law on Planning, the Law on Environmental Protection, the Law on Investment, etc.
At the same time, attention should be paid to environmental protection and land reclamation after the end of mineral mining. There is currently no clear mechanism to force businesses to rehabilitate the environment after mining, leading to many abandoned mine areas, affecting the community and locality.
Chairman of the Committee Nguyen Thanh Hai also suggested that the draft Law should clearly stipulate the mechanism for sharing benefits from mineral exploitation, ensuring the rights of localities and communities in places where mineral exploitation activities take place, such as compensation and resettlement support.

In his concluding remarks, Vice Chairman of the National Assembly Le Minh Hoan requested the Government to continue reviewing and perfecting regulations on delimiting areas where mineral exploitation rights are not auctioned to ensure publicity and transparency, consistent with the actual exploitation, processing and usage capacity of cement factories and mineral processing factories operating in accordance with the law, avoiding speculation, mine holding, profiteering and not negatively affecting the development of new mineral exploration and exploitation projects as prescribed.
Regarding regulations on rare earth management, the Vice Chairman of the National Assembly requested the Government to direct the continued review and completion of regulations on rare earth management, ensuring the institutionalization of the General Secretary's direction at the working session with representatives of relevant agencies on the strategy for management, exploitation and use of rare earth resources to serve the country's development.
"Regulations on the management, processing and use of rare earths must create a legal corridor to promote the development of the industry of mining, processing and using rare earth minerals in a synchronous and effective manner; ensuring sustainable development in terms of socio-economy, environment, national defense, security, foreign affairs, international cooperation, bringing the highest benefits to the country," the Vice Chairman of the National Assembly emphasized.
At the same time, it is necessary to study more specific regulations on some contents such as: the mechanism for the State to designate or permit new rights to explore, exploit, process and use rare earth; the content of deep processing of rare earth and use of rare earth.
