Accordingly, the authority of each agency, from the central to local levels, will be redefined in a clearer and more detailed manner to close legal loopholes and improve the effectiveness of the fight against corruption.
In an effort to institutionalize the Party's guidelines and policies on anti-corruption and overcome shortcomings of current laws, the drafting agency, with the Government Inspectorate as the chair, has completed the draft proposal to amend and supplement a number of articles of the 2018 Law on Anti-Corruption.
The core objective of this amendment is to build a tight and effective power control mechanism, suitable for the new organizational model of the political system and practical requirements.
According to the draft proposal of the Government Inspectorate, the Central Inspection Committee will control the assets and income of those under the management of the Politburo and Secretariat.
Central Party committees and agencies, and Party committees directly under the Central Party Committee control the assets and income of those who are required to declare assets and income under their management authority.
The Government Inspectorate controls the assets and income of people holding positions of department head and equivalent or higher working at ministries, ministerial-level agencies, government agencies and other agencies, units and organizations established by decision of the Government or the Prime Minister.
Heads and deputy heads of organizations established by decision of the Government or Prime Minister or whose charter of operations is approved; chairman of the board of directors, vice chairman of the board of directors, general director, deputy general director, member of the board of directors, member of the board of members... of state-owned enterprises managed by ministries and ministerial-level agencies; persons obliged to declare assets and income working at the Government Inspectorate.
The Supreme People's Court, the Supreme People's Procuracy, the State Audit, the Office of the National Assembly, the Office of the President, the National Assembly Delegation Work Committee, and central agencies of socio-political organizations control the assets and income of those obligated to declare under their management authority.
Ministries, ministerial-level agencies, and government agencies shall control the assets and income of declarants under their management authority.
Along with that, a control model at the local level is also proposed with a parallel, clear structure between the Party's inspection agency and the government's inspection agency.
The Provincial and Municipal Party Committees' Inspection Committees control the assets and incomes of those under the management of the Provincial and Municipal Party Committees' Standing Committees and those who are required to declare their assets and incomes in the Party agencies of the province.
Provincial and municipal inspectors control the assets and income of people who are required to declare their work at state agencies, organizations, units and enterprises under the management authority of local authorities.
According to the Government Inspectorate, this amendment aims to uniformly and synchronously regulate the agencies controlling assets and income, avoiding overlapping and unclear authority; at the same time, ensuring synchronization and conformity with the Party's regulations on controlling assets and income in Decision 56-QD/TW dated February 8, 2022 of the Politburo.
