US court issues important ruling on post-election vote counting

A three-judge panel of the 5th Circuit Court of Appeals in New Orleans ruled on October 25 that it was illegal for states to count ballots received after Election Day, a victory for Republicans, according to Reuters.

According to Reuters, the Republican National Committee, the Mississippi Republican Party and two Republican voters filed a lawsuit in January, challenging Mississippi's law that allows an additional five days after Election Day to receive and count ballots.

The court did not strike down the law, but instead ruled that the practice was illegal and left it to the trial court to decide the next step. The decision only applies to the three states under the jurisdiction of the 5th Circuit Court of Appeals: Mississippi, Texas, and Louisiana.

US election workers describe ballot processing steps

Judge Andrew Oldham argued that Mississippi's law was hindered by a federal law that requires congressional and presidential elections to be held on one day. "Federal law requires voters to take timely steps to vote on Election Day. And federal law does not permit Mississippi to extend the voting period by one day, five days, or 100 days," Oldham wrote.

A spokesman for Mississippi Attorney General Lynn Fitch said he respects the court's decision and looks forward to the next steps in the case. Republican National Committee Chairman Michael Whatley praised the ruling, calling it a major victory for election integrity.
