Hanoi tightens regulations on stopping electricity and water for constructions violating fire prevention and fighting regulations.

The Hanoi People's Council (HĐND) has passed a resolution amending regulations on stopping the supply of electricity and water to constructions and facilities violating fire prevention and fighting regulations. The resolution supplements the authority of the People's Committee at the commune level, and clearly stipulates the conditions for applying and terminating the measure, in order to enhance management effectiveness and ensure community safety.

On the afternoon of September 29, delegates of the Hanoi People's Council discussed and unanimously approved the Resolution amending and supplementing a number of articles of Resolution No. 33/2024/NQ-HDND dated November 19, 2024. This is a document regulating the application of measures requiring the suspension of electricity and water services to construction works, production, business and service establishments that violate regulations on fire prevention and fighting (PCCC).

According to the new resolution, many important provisions have been revised and supplemented. Specifically, clauses 4, 5 and 6 of Article 3 clearly stipulate the following violations: construction works subject to approval or appraisal of fire prevention and fighting design but still being constructed without written approval; construction works not in accordance with the approved and appraised fire prevention and fighting design; or construction works, items, production and business establishments that have been suspended because they have not been accepted for fire prevention and fighting but are still put into operation and do not comply with the requirements of the competent authorities.

The amended resolution also supplements Article 4, assigning the Chairman of the People's Committee at the commune level the authority to apply measures to stop the supply of electricity and water services in cases of violations. In cases where the violating construction is located in two or more communes or wards, the head of the local government where the violation was first detected or where the violating construction area is larger will be responsible for implementation. The person with the authority to apply this measure is also the person with the authority to terminate the measure when the violating organization or individual has corrected the violation according to regulations.

In Article 6, clauses 3, 4, 5 and 6 are amended and supplemented, specifying the conditions for terminating the measure of stopping the supply of electricity and water. Accordingly, the construction works subject to violations must have a document approving or assessing the adjusted fire prevention and fighting design, and a remedial plan that has been commented on or approved by the competent authority. For facilities that have been suspended from operation, there must be a decision to restore or a document approving the results of the fire prevention and fighting acceptance, along with the termination of the violation.

Article 7 is also amended, stipulating that within 1 day of receiving all records and documents as prescribed in Article 6, the competent authority must inspect and make a record confirming the compliance of the violating organization or individual according to the unified form issued with the resolution.

Notably, Article 8 is supplemented with provisions on construction works, production and business establishments being considered for termination of measures to stop providing electricity and water services when there are sufficient documents proving that violations have been remedied, including documents approving, assessing or adjusting fire prevention and fighting designs by competent authorities.

According to the City People's Committee's Submission, the development and promulgation of this resolution aims to specify Clause 4, Article 33 of the Capital Law, while ensuring compliance with the provisions of the law on local government. The resolution is also affirmed to be consistent with the Party's policies and guidelines and current laws, contributing to enhancing the consistency, unity, constitutionality and legality of the system of legal documents.

The empowerment of the People's Committee at the commune level in handling violations is considered an important step, both enhancing decentralization and delegation of power to local authorities and creating an effective control tool for construction, production and business activities related to fire safety. At the same time, the new regulation also ensures transparency and clarity in the responsibilities and authorities of each level of government, thereby improving the effectiveness and efficiency of state management at the local level.

The resolution, once issued, will become an important legal basis for Hanoi city to tighten discipline in construction management and fire prevention, promptly prevent violations, protect community safety and ensure sustainable development in the area.
