Sam Son City organizes trial under shortened procedure

The People's Procuracy of Sam Son City has just coordinated with the same-level prosecution agencies to choose to apply the shortened procedure to resolve the case of Pham Ba Thanh committing the crime of "Theft of property" as prescribed in Clause 1, Article 173 of the Penal Code.

According to the prosecution decision: At about 10:30 a.m. on July 17, 2023, Pham Ba Thanh, born in 1976, in Cam Van commune (Cam Thuy) went to the beach on the east side of Ho Xuan Huong street in Son Hai residential group, Truong Son ward, Sam Son city to swim. Taking advantage of the moment when Ms. Pham Thi Hanh, born in 2005, in Ngoc Trung commune (Ngoc Lac) parked her Honda Wave Alpha motorbike with license plate 36K5 - 280.95 without removing the key, Thanh stole Ms. Hanh's motorbike and was discovered and caught red-handed. The value of the motorbike Thanh stole was 10 million VND.

After examining the records, based on the provisions of Articles 456 and 457 of the Criminal Procedure Code, and finding that the conditions were met, the Prosecutor and the Investigator agreed to report to the leadership to issue Decision No. 01/QD-CQCSDT dated July 20, 2023 to resolve the case under the simplified procedure. As a result, after 6 days (from the date of the Decision to initiate the case), the Investigation Agency issued a Decision to propose prosecution; after 2 days (from the date of receiving the Decision to propose prosecution), the Sam Son City People's Procuracy issued a Decision to prosecute; after 9 days (from the date of acceptance), the Sam Son City People's Court opened a trial to try the defendant.

Drawing on experience from the trial, representatives of the prosecution agencies unanimously assessed that the procedural steps for resolving cases under the simplified procedure were in compliance with the provisions of the Criminal Procedure Code; evidence and documents were fully collected; ensuring the rights and obligations of the accused, defendants and participants in the proceedings. In the coming time, the inter-agency consensus was to increase the application of the simplified procedure for eligible cases, actively contributing to the timely and effective fight against crime.
