The Ho Chi Minh City Inspectorate has just named three businesses that have seized State assets and real estate and concluded that their actions are illegal, causing great damage to State money and assets.
The Ho Chi Minh City Inspectorate has just issued a conclusion on "Responsibilities of the Chairman of District 1 People's Committee in implementing the law on inspection, receiving citizens, complaints, denunciations and management and use of houses, land and assets attached to land under state ownership in District 1 (period 2022-2023)"
In the conclusion related to houses, land and assets attached to land owned by the State directly managed and monitored by District 1 Public Service Company Limited (referred to as District 1 Public Service Company), the Ho Chi Minh City Inspectorate recorded signs of violations by a number of land-leasing enterprises.
Specifically, through working with relevant units, the City Inspectorate noted that 3 businesses renting 6 house and land addresses have incurred arrears in rent for many years (accumulated from 2018 to June 30, 2024 is more than 20 billion VND, accounting for 95.48% of the arrears) but have been slow to liquidate contracts and terminate the lease.
These three enterprises are Saigon 1 Food Production and Trading Joint Stock Company, Saigon Post and Telecommunications Services Joint Stock Company (SPT), and General Import-Export Joint Stock Company II.
According to the City Inspectorate, up to now, although the lease (temporary lease) has expired for many years, these 3 enterprises still occupy 4/6 house and land addresses and 6/6 house and land addresses still owe large rent arrears (of which the land rent is more than 15 billion VND).
In particular, through inspection and recording in the period of 2022-2023, the 3 above-mentioned enterprises all used real estate addresses to do business and earn profits. There were even addresses that generated sub-lease and collected rent from partners for many years, but cited business difficulties as reasons for not paying rent and also not returning the real estate, not committing to a time limit for recovery.
According to the Inspectorate, the act of three enterprises occupying State-owned houses and land and not paying rent is an illegal act, potentially causing great loss of State money and property.
Thereby, the Inspectorate concluded that these shortcomings and violations belonged to the People's Committee of District 1, the Director of District 1 Public Utility Company, the deputy directors in charge and related organizations and individuals during the time the incident occurred.
Currently, District 1 Public Utility Company has filed a lawsuit at District 1 People's Court under the guidance of District 1 Police.
