Increase driving age

The Law on Road Traffic Order and Safety (ATGT) was passed by the National Assembly on June 27, effective from January 1, 2025. The Law adds a number of new provisions, specifically:

Article 59 of the latest Law on Road Traffic Safety stipulates the age and health of drivers participating in road traffic:

People 16 years of age or older are allowed to drive motorbikes;

People aged 18 years or older are granted a driving license of class A1, A, B1, B, C1, and a certificate of training in road traffic law to drive specialized motorbikes on the road;

People 21 years of age or older are granted a class C, BE driver's license;

People 24 years of age or older are granted driving licenses of class D1, D2, C1E, CE;

People 27 years of age or older are granted driving licenses of class D, D1E, D2E, DE;

The maximum age for drivers of passenger cars (including buses) with more than 29 seats (excluding the driver's seat) and sleeper cars is 57 years old for men and 55 years old for women.

Drivers of vehicles participating in road traffic must ensure health conditions appropriate to the type of vehicle they are allowed to drive.

The Minister of Health shall prescribe health standards and health examinations for drivers and operators of specialized motorbikes; periodic health examinations for car drivers; and establish a database on the health of drivers and operators of specialized motorbikes.

Compared with the current regulations in the 2008 Road Traffic Law, the maximum age of drivers of vehicles with more than 29 seats in the latest Road Traffic Safety Law has increased by 5 years for women and 2 years for men (previously women were 50 years old and men were 55 years old).

Regulations on working hours not exceeding 48 hours/week

According to Article 64 of the Law on Road Traffic Safety, working hours of drivers of commercial and internal transport vehicles are regulated.

According to this Law, the driving time of a car driver shall not exceed 10 hours in a day and not exceed 48 hours in a week; driving continuously shall not exceed 04 hours and shall ensure relevant provisions of the Labor Code.

Transport business units, internal transport operating units and drivers of transport business and internal transport vehicles are responsible for implementing the provisions of this Article.

Compared with the 2008 Road Traffic Law, the latest Road Traffic Safety Law still maintains the regulation that car drivers must not drive more than 10 hours a day; must drive continuously for no more than 4 hours and must ensure relevant provisions of the Labor Code as prescribed in the 2008 Road Traffic Law.

However, the Law on Road Traffic Safety adds a regulation that the working time of a driver is not to exceed 48 hours a week.

Road traffic rules

According to Article 11 of the Law on Road Traffic Safety, traffic participants must drive on the right side of the road, in the correct lane and road section, comply with road signs and other road traffic rules.

Drivers and passengers in vehicles must wear seat belts where seat belts are available when participating in road traffic.

When transporting children under 10 years old and under 1.35 meters tall in a car without an adult sitting with them, the driver must use and instruct on the use of appropriate child safety equipment.

When transporting children under 6 years old by motorbike or scooter, there must be a seat belt or a child seat or an adult sitting with the child in the back.

The driver and attendants on the vehicle are responsible for instructing, requesting, and checking that passengers wear seat belts throughout the vehicle's journey.
